1. Heard learned counsel for the applicant and learned A.G.A. for the State.

2. The present application is filed with the prayer to quash the entire proceeding arising out of Case Crime No.0192 of 2023 under Section 306 I.P.C., Police Station Krishna Nagar, District - Lucknow.

Learned counsel for the applicant submits that deceased and one Akansha Tiwari were in friendship and there was some dispute in between them, applicant was tried to convince the deceased but he committed suicide as Akansha Tiwari has broken friendship, thereafter, on the basis of concocted facts, F.I.R. of the case in question was lodged. He further submits that charge sheet was submitted by the Investigating Officer against Akansha Tiwari and applicant for being friend on the presumption, there is no ingredient of abatement in the entire case diary. He also submits that in the application filed by Akansha Tiwari, i.e., Application U/S 482 No.7651 of 2025 protection has been granted by this Court vide order dated 15.9.2025 and relies on he decision of Hon'ble Supreme Court in the case of Ude Singh & Ors. Vs. State of Haryana reported in (2019) 17 SCC 301 and Ramesh Kumar Vs. State of Chhatisgarh reported in (2001) 9 SCC 618 and requested for indulgence of this Court.

4. Learned A.G.A. opposes the prayer of the applicant but he does not dispute this fact that protection has been granted to the coaccused - Akansha Tiwari. He further prays for some time to file counter affidavit.

5. Considering the submissions of learned counsel for the parties, going through the contents of the application as well as other relevant documents, it is evident that in the case of co-accused, protection has already been granted, therefore, matter requires consideration.

6. Issue notice to the private respondent.

7. List this case in the month of January, 2026 alongwith Application U/S 482 No.7651 of 2025.

8. Until further order, impugned proceedings shall remain stayed.
