"Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be please to quash the order dated 06.09.2025 passed by the Additional Sessions Judge/F.T.C., Gonda in Criminal Revision No. 379 of 2024, CNR No. UPGD01004235-2024 as well as quashing of order dated 22.02.2024 passed in Case No. 1700541 of 2017 (Smt. Rani Devi Vs. Dukhharan and others), P.S. Mankapur, District- Gonda passed by the Additional Chief Judicial Magistrate-1st, Gonda. (Contained as Annexure No. 1 80 2).

It is further prayed that this Hon'ble Court may kindly be pleased to quash the Final Report No. 11 of 2015 dated 16.03.2015 arising out of Case Crime No. 215 of 2015, FIR No. 71 of 2015, U/s-419, 420, 467, 468, 471, 504 & 506 I.P.C. corresponding section-319(2), 318(4), 338, 336(3), 340(2), 352, 351(2)/(3) B.N.S. and to direct the S.H.O., P.S. Kotwali Mankapur, District Gonda to investigate the matter without taking any favour of the parties, in the interest of justice. (Contained as Annexure No. 3)."

Vide order dated 22.07.2024, passed by the Additional Chief Judicial Magistrate-I, Gonda the complaint case was dismissed. The relevant portion of the order dated 22.07.2024 reads as under :-

पत्रावली आज तलबी आदेश हेतु िनयत है। पिरवािदनी के अिधवक्ता की पूवर् िनयत ितिथ पर सुना जा चुका है।

प्रस्तुत मामलें में प्रोटेस्ट प्राथर्ना पत्र पर उपरोक्त मामलें को पिरवाद के रूप में दजर् कर पिरवािदनी का बयान अन्तगर्त धारा 200 द०प्र०सं० एवं साक्षीगण का बयान धारा 202 द०प्र०सं० दजर् िकया गया।

पिरवािदनी श्रीमती रानी देवी ने बयान अन्तगर्त धारा 200 दं०प्र०सं० में कथन िकया है िक मेरे पित श्री सत्यनरायण की जमीन रेनू िसह एवं पुष्पा िसह ने मेरे देवर के लड़के दुःखहरन से जबरदस्ती बैनामा िलखवा िलए। मैं थाने पर गयी थी लेिकन कोई कायर्वाही नही होने पर एस०पी० को जिरये रिज० सूचना िदया। वहां कोई कायर्वाही नहीं होने पर न्यायालय आयी हूँ। जमीन मेरे पित के नाम है।

पत्रावली पर उपलब्ध समस्त प्रपत्रों का पिरशीलन िकया। पिरवािदनी ने कथन िकया है िक उसके पित की जमीन को रेनू िसह एवं पुष्पा िसह ने पिरवािदनी के देवर के लड़के दुःखहरन से जबरदस्ती बैनामा िलखवा िलया जबिक जमीन पिरवािदनी के पित के नाम दजर् है। पत्रावली पर बैनामा की छायाप्रित संलग्न है िजसके अवलोकन से िविदत है िक उपरोक्त बैनामा पंजीकृत दस्तावेज है िजसके वैध माने जाने की उपधारणा की जाती है। प्रकरण िसिवल प्रकृित का है। जमीन के स्वािमत्व के सम्बन्ध में उदघोषणा करना या मामलें का िनस्तारण करना िसिवल न्यायालय के क्षेत्रािधकार में आता है। पिरवािदनी द्वारा िसिवल प्रकृित के बाद को फौजदारी स्वरूप देने का प्रयास िकया जा रहा है। माननीय उच्चतम न्यायालय िक िविध व् य वस्था सैय्यद यासीर इब्रािहम बनाम स्टेट आफ यू०पी० में माननीय उच्तम न्यायालय द्वारा यह अवधािरत िकया गया है िक The continuation of the prosecution against the appellant would amount to an abuse of the process where a civil dispute is sought to be given the colour of criminal wrong doing. एवं माननीय उच्च न्यायालय इलाहाबाद द्वारा िनणीर्त की गयी िविध व्यवस्था Pragati Devi Vs. State of U.P. & others, Criminal Revision No.2777 of 2016 के मामलें में अवधािरत िकया गया है िक It is a fact that at the time of passing order on point of cognizance and summoning, the Magistrate is expected to consider as to whether prima facie evidence for summoning the accused are available or not. But this consideration has to be after application of judicial mind, and not blindly. Magistrate is not expected only to read the words uttered by witnesses under section 200 or 202 CrPC. but he also required to use its judicial mind before passing any order and not to act like a silent spectator of the word uttered by the witnesses, who were not going to be cross-examined at the stage to evidence under Chapter XV CrPC

अतः माननीय उच्चतम न्यायालय व माननीय उच्च न्यायालय की उपरोक्त िविध व्यवस्थाओं तथा उपरोक्त िवश्लेषण से प्रकरण िसिवल प्रकृित का प्रतीत होता है। िवपक्षीगण को उपरोक्त मामले में तलब िकये जाने का आधार पयार्प्त नहीं है। पिरवाद अन्तगर्त धारा 203 दं०प्र०सं० में खािरज िकये जाने योग्य है।

उपरोक्त पिरवाद अन्तगर्त धोरा 203 दं०प्र०सं० के तहत खािरज िकया जाता है। पत्रावली िनयमानुसार दािखल दफ्तर हो।"

Being aggrieved by the order dated 22.07.2024, the applicant Smt.Rani filed the Criminal Revision No.379 of 2024 (Rani Devi Vs. State of U.P. and 06 others). The Additional Session Judge/F.T.C., Naveen, Gonda (in short "Revisional Court") dismissed the revision vide order dated 06.09.2025 and affirmed the order of the Additional Chief Judicial Magistrate-I, Gonda dated 22.07.2024. The relevant portion of the order dated 06.09.2025 reads as under :-

" 9- पत्रावली के अवलोकन से िविदत होता है िक पिरवािदनी द्वारा पंजीकृत कराये गये मुकदमा अपराध संख्या-215/2015, अन्तगर्त धारा 419, 420, 467, 468, 471, 504, 506 भारतीय दण्ड संिहता, थाना मनकापुर, िजला गोण्डा में सम्बिन्धत थाने द्वारा बाद िववेचना अिन्तम िरपोटर् संख्या-11/2015, िदनांिकत 16.03.2015 समक्ष न्यायालय प्रेिषत िकया, िजसके िवरूद्ध पिरवािदनी द्वारा प्रोटेस्ट प्राथर्नापत्र िदनांिकत 10.05.2017 न्यायालय के समक्ष प्रस्तुत िकया गया। उक्त प्रोटेस्ट प्राथर्नापत्र पर पिरवािदनी के िवद्वान अिधवक्ता की बहस सुनने के पश्चात िवद्वान िवचारण न्यायालय द्वारा अिन्तम िरपोटर् सं0-11/2015 िदनांिकत 16.03.2015 िनरस्त कर पिरवािदनी के प्रोटेस्ट प्राथर्नापत्र को स्वीकार िकया गया तथा प्रस्तुत प्रकरण को पिरवाद के रूप में दजर् िकये जाने का आदेश पािरत िकया। इसके पश्चात पिरवािदनी के बयान धारा-200 दं० प्र० सं० व अन्य साक्षीगण पी० डब्लू0-1 सुरेन्द्र कुमार व पी० डब्लू0-2 िदलीप कुमार का बयान अन्तगर्त धारा-202 दंण्ड प्रिक्रया संिहता समक्ष न्यायालय अंिकत िकये गये। पिरवािदनी रानीदेवी ने अपने बयान धारा-200 दंण्ड प्रिक्रया संिहता में कथन िकया है िक मेरे पित सत्यनरायन की जमीन रेनू िसह एवं पुष्पा िसह ने मेरे देवर के लड़के दुःखहन से जबरदस्ती बैनामा िलखवा िलए। जमीन मेरे पित के नाम है। उपरोक्त कथनो का समथर्न पी० डब्लू0-1 सुरेन्द्र कुमार व पी० डब्लू0-2 िदलीप कुमार ने िकया है। िवद्वान िवचारण न्यायालय द्वारा िदनांक 22.07.2024 को आदेश पािरत िकया गया िक पत्रावली पर बैनामा की छायाप्रित संलग्न है, िजसके अवलोकन से िविदत है िक उपरोक्त बैनामा पंजीकृत दस्तावेज है, िजसके वैध माने जाने की उपधारणा की जाती है। प्रकरण िसिवल प्रकृित का है। जमीन के स्वािमत्व के सम्बन्ध में उद्घोषणा करना या मामले का िनस्तारण करना िसिवल न्यायालय के क्षेत्रािधकार में आता है। पिरवािदनी द्वारा िसिवल प्रकृित के वाद को फौजदारी स्वरूप देने का प्रयास िकया जा रहा है और उच्चतम न्यायालय की िविध व्यवस्था सैय्यद यािसर इब्रािहम बनाम उत्तर प्रदेश राज्य में अवधािरत िकया गया है िक-

माननीय उच्च न्यायालय इलाहाबाद की िविध व्यवस्था प्रगित देवी बनाम उत्तर प्रदेश राज्य एवं अन्य िक्रिमनल िरवीजन संख्या-2771/ 2016 में भी अवधािरत िकया गया है िक-

"It is a fact that at the time of passing order on point of cognizance and summoning, the Magistrate is expected to consider as to whether prima facie evidence for summoning the accused are available or not. उपरोक्त का हवाला देते हुए िवद्वान िवचारण न्यायालय ने पिरवाद पत्र को धारा-203 दंण्ड प्रिक्रया संिहता के अन्तगर्त खािरज कर िदया गया।

10- तलिवदा पत्रावली के साथ संलग्न मुकदमा अपराध संख्या-215/2015 की केस डायरी के अवलोकन से िविदत है िक िववेचक ने दौरान िववेचना साक्ष्य संक्लन िकया है, िजसके अनुसार िनगरानीकतार्/पिरवािदनी के पित तीन सगे भाई थे। कस्बा मनकापुर के मो० आजाद नगर व मोहल्ला पटेल नगर में िस्थत सम्पित्त का आपसी पािरवािरक बंटवारा कर िलया गया

था। उक्त तीनों भाई सत्य नरायाण, सूयर्लाल व राधेश्याम मृतक हो चुके हैं, िजनके मध्य सम्पित्त को लेकर िकसी प्रकार का कोई िववाद नही हुआ। िवद्वान अवर न्यायालय का उपरोक्त मत पूणर्तः िविध सम्मत है िक प्रश्नगत बैनामा पंजीकृत दस्तावेज है, िजसके वैध माने जाने की उपधारण की जाती है। प्रकरण िसिवल प्रकृित का है। जमीन के स्वािमत्व के सम्बन्ध में उद्योषणा करना या मामले का िनस्तारण िसिवल न्यायालय की क्षेत्रािधकािरता में आता है। पिरवािदनी द्वारा िसिवल प्रकृित के वाद को फौजदारी का स्वरूप िदये जाने का कायर् िकया जा रहा है। इसके अितिरक्त िनगरानीकतीर्/पिरवािदनी द्वारा यह स्वीकार िकया गया है िक उक्त पक्षकारों के मध्य िदवानी न्यायालय में वाद भी लिम्बत है।

11 अिमत कपूर बनाम रमेश चन्द (2012) 9 एस.सी.सी. पृष्ठ 460 के िनणर्य द्वारा माननीय सवोर्च्च न्यायलाय ने यह अिभमत िनधार्िरत िकया है िक अवर न्यायालय द्वारा जो तथ्य िनष्कषर् में िदये गये है, उन्हें िनगरानी न्यायालय जब िवखिण्डत करने, जब तक िक अवर न्यायलय द्वारा गम्भीर त्रुिट या घोर अिनयिमतता न बरती गयी हो।

12. माननीय सवोर्च्च न्यायालय द्वारा िवनय त्यागी बनाम इरशाद अली (2013)5 एस.सी.सी. पृष्ठ 762 में इस आशय का िविधक िसद्धान्त प्रितपािदत िकया गया है िक सामान्यतः पुनरीक्षण क्षेत्रािधकार िविध के प्रश्न पर ही प्रयुक्त िकया जाना चािहये, तथ्यो के िवश्लेषण के समय यह ध्यान रखे जाने योग्य है िक तथ्य सम्बन्धी िनष्कषर् िवकृत होने की दशा में पुनरीक्षण क्षेत्रािधकार का प्रयोग िकया जाना िविधनुसार अनुमन्य है।

13. अतः उक्त िववेचना, उद्धत िनणर्य िविध एवं पत्रावली के अवलोकन उपरान्त मैं इस मत का हूं िक िवद्वान न्यायालय अपर मुख्य न्याियक मिजस्ट्रेट प्रथम, गोण्डा द्वारा पिरवाद संख्या1700541/ 2017, श्रीमती रानी देवी बनाम दुःखहरन आिद में पािरत आलौच्य आदेश िदनांिकत 22.07.2024 िजसके द्वारा िनगरानीकतीर् का वाद 203 में खािरज िकया गया है, वह िविध सम्मत आदेश है जो िक पत्रावली पर उपलब्ध साक्ष्य के अनुरूप है। आलौच्य आदेश में कोई अवैधािनकता नही है, अिपतु िवस्तृत आदेश कारण सिहत िवद्वान अवर न्यायालय ने युिक्त-युक्त तरीके से अपने क्षेत्रािधकार का प्रयोग करते हुये पािरत िकया गया है। फलस्वरूप िनगरानी मे कोई बल नही है तथा िनगरानी खािरज िकये जाने योग्य है।

आदेश

14. िनगरानीकतार् रानी देवी द्वारा प्रस्तुत दािण्डक िनगरानी संख्या-379/2024 िनरस्त की जाती है। िवद्वान न्यायालय िवद्वान न्यायालय अपर मुख्य न्याियक मिजस्ट्रेट प्रथम, गोण्डा द्वारा पािरत आलौच्य आदेश िदनांिकत 22.07.2024 पुष्ट िकया जाता है। इस आदेश की प्रित अवर न्यायालय को अिवलम्ब प्रेिषत हो।"

Upon due consideration of the facts of the case as pleaded as also the submissions advanced by the learned counsel for the parties, who are present before this Court, this court finds that the present application is liable to be rejected. It is for the following reason(s) :-

(i) After execution of sale-deed related to property over which applicant is claiming rights, the applicant instituted a Civil Suit No.312 of 2015 (Rani Devi Vs. Dikhharan and others) seeking the decree of perpetual injunction.

(ii) Another civil suit, details of which are not available on record is also pending.

¶46

(iii) The aforesaid aspect of the csae has not been refuted by the counsel for the applicant.

(iv) With regard to execution of sale-deed an F.I.R. registered as Case Crime No.215

of 2015, under Sections 419, 420, 467, 468, 471, 504, 506 I.P.C., Police Station - Mankapur, District - Gonda was lodged.

(v) After completion of investigation, the Final Report No.11/2015, dated 16th March, 2015 was submitted before the court concerned against which protest application was filed and thereafter statement(s) as required under Section(s) 200 and 202 Cr.P.C. were recorded and the Magistrate concerned after considering the material available on record including the registered sale-deed, rejected the application observing that the complainant/applicant to a civil dispute wants to give a criminal colour.

(vi) From the record it appears that the sale deed executed by the opposite party till date has not been set aside/cancelled.

(vii) Private Opposite parties are claiming the rights over the property in issue on the basis of 'Will' dated 31.12.1984 executed by Satya Narayan @ Sattu (husband of the applicant), which has also not been cancelled till date.

Taking note of the aforesaid, this court is of the view that in passing the impugned order(s), no illegality has been committed.

Accordingly, the application stands dismissed. Cost made easy.
