Heard learned counsel for the applicants, learned AGA and perused the record.

The present application has been filed for the following main reliefs:

"Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the impugned order dated 01.08.2025 passed by learned Sessions Judge, Barabanki in Criminal Revision No.89/2025, titled as Virendra Kumar Gupta and others V/s State of Uttar Pradesh and another and summoning order dated 08.04.2025 in Complaint Case No.916/2023, Mohd. Junaid V/s Virendra Kumar Gupta and others, under section 323, 504, 506, 406 IPC, P.S. Badosarai, District-Barabanki, contained in Annexure No.1 and 2 to this petition, in the interest of justice.

It is further prayed that this Hon'ble court may kindly be pleased to quash the entire proceeding of Complaint Case No.916/2023, Mohd. Junaid V/s Virendra Kumar Gupta and others, under section 323, 504, 506, 406 IPC, P.S. Badosarai, District-Barabanki, pending in the court Additional Chief Judicial Magistrate, Court No. 12, Barabanki."

At the very outset, counsel for the applicants states that applicants will surrender before the trial court and apply for bail. However, he has submitted that applicants may be granted the benefit of the case of Satender Kumar Antil Vs. Central Bureau of Investigation and another, reported in

It is, therefore, directed that in case the applicants surrender before the Court below within three weeks from today and prefer bail application, the trial court will decide the said bail application, as expeditiously as possible, taking into account the law laid down by the Supreme Court in the case of Satender Kumar Antil (supra).

Learned counsel for the applicants also requested for discharge application. He may move the same at the appropriate time.

For a period of three weeks from today, no coercive action shall be taken against the applicant in the aforesaid case.
