Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

This application under Section 482 Cr.P.C. has been filed assailing the order dated 20.01.2021, passed by the Additional Chief Judicial Magistrate, Court No.9, Unnao in Misc. Case No.401/2020 (Ram Babu Vs. Sujeet Kumar and others), whereby the Magistrate has rejected the application preferred under Section 156 (3) Cr.P.C. The relevant portion of the order dated 20.01.2021 reads as under :-

" सुना पत्रावली का परि�शीलन किकया। आवेदक �ामबाबू द्वा�ा यह प्रार्थ�ना पत्र अन्तर्ग�त धा�ा- 156(3) सी०आ�०पी०सी० में यह कर्थन किकया र्गया किक भूमिम संख्या - 00434 की र्गाटा संख्या- 1145 क्षेत्रफल 0.2400 हे० के 1/6 अंश अर्था�त कुल क्षेत्रफल लर्गभर्ग 0.040 हे० भूमिम का तनहा स्वामी है। जो किक बटवा�े के समय प्रार्थ1 को मिमली र्थी तर्था उक्त भूमिम संख्या 1145 में विवपक्षीर्गण 1 लर्गायत 6 ने अपने हिहस्से की सम्पूण� भूमिम पहले ही विवक्रय क� हिदया र्था तर्था अब इस भूमिम संख्या - 1145 में विवपक्षीर्गण 1 लर्गायत 6 का कोई अधिधपतय नहीं �ह र्गया है।

आवेदक का यह कर्थन किक विवपक्षीर्गण 1 लर्गायत 6 द्वा�ा उसके हिहस्से की भूमिम 1145 क्षेत्रफल 0.040 हे० में से क्षेत्रफल 135.69 वर्ग�मीट� भूमिम का विवक्रय विवपक्षी संख्या - 7 महाबी� मिसंह पुत्र देवी बक्स मिसंह के पक्ष में हिदनांक - 13.06.2018 को क� हिदया जिजसका कोई अधिधका� विवपक्षी संख्या- 1 लर्गायत 6 को नहीं र्था। जब आवेदक द्वा�ा निनष्पाहिदत बैनामें की जानका�ी हिदनांक - 07.09.200 को हुयी तब विवपक्षी संख्या- 7 महाबी� मिसंह के हक में निनष्पाहिदत बैनामें की पक्की नकल उसके द्वा�ा ली र्गयी।

उक्त प्रक�ण में सव�प् र म प्रस्त� संख्या 2 में उजि?लखिAत कर्थन में यह स्पष्ट नहीं हे किक आवेदक तर्था विवपक्षीर्गण लर्गायत 6 जो किक एक ही परि�वा� के सदस्य है के द्वा�ा बटवा�े के पश्चात प्राप्त हिहस्से किकस आधा� प� सृजिजत किकया र्गया है। अर्था�त उक्त बटवा�े के सम्बन्ध में किकसी भी प्रका� का कानूनी प्रपत्र आवेदक द्वा�ा पत्रावली प� प्रस्तुत नहीं किकया र्गया है। जिजससे यह स्पष्ट हो सके की उक्त बटवा�ा विवधिधक बटवा�ा है अर्थवा नहीं। तर्था विवधिध की दृष्ट में मौखिAक बटवा�े का कोई महत्व व विवधिध मान्यता नहीं है।

चूंकिक आवेदक द्वा�ा यह कहना है किक उसके हिहस्से की भूमिम का अंश 135.69 वर्ग� मीट� विवपक्षी संख्या -1 लर्गायत 6 द्वा�ा पंजीकृत बैनामा क� हिदया र्गया है। जहाँ विवधिध की सामान्य उपधा�ाण यह है किक किकसी भी बैनामे की सत्यता को तबतक प्रनितकूल नहीं माना जा सकता जबतक किक किकसी सक्षम मिसविवल न्यायालय द्वा�ा ऐसे बैनामे की विवधिध मान्यता को AजिLMत न क� हिदया जाये।

अतः उक्त समस्त विवश्लेषण से यह प्रक�ण विवशुद्ध रूप से मिसविवल प्रकृजिक्त का है तर्था आवेदक सक्षम मिसविवल न्यायालय के समक्ष वाद योधिचत क�के अनुतोष की प्राजिप्त क� सकता है। विवधिध व्यवस्र्था अजीत मिसंह बनाम उत्त� प्रदेश �ाज्य 2006 (6) ALJ इलाहाबाद ( पूण� पीठ ) में माननीय न्यायालय द्वा�ा यह अमिभनिनधा�रि�त किकया र्गया है किक यहिद प्रार्थ�ना पत्र में अन्त� निनहीत विववाद मिसविवल प्रकृजिक्त का हे तो ऐसे प्रार्थ�ना पत्र को निन�स्त क� देना चाहिहए , या जहाँ प्रार्थ�ना पत्र में मिसविवल उपचा� उपलब्ध हो तो भी ऐसे प्रार्थ�ना पत्र को निन�स्त क� देना चाहिहए। अतः प्रार्थ�ना पत्र अन्तर्ग�त धा�ा -156 (3) सी०आ�०पी०सी निन�स्त किकये जाने योग्य है। "

The applicant has also challenged the order dated 18.10.2021, passed by Additional Session Judge, Court No.1, Unnao in Criminal Revision No.12 of 2021 (Ram Babu Vs. State and 07 others). By this order, the Revisional Court has dismissed the criminal revision filed by the applicant challenging the order dated 20.01.2021, passed by the Magistrate, indicated above. The relevant portion of the order dated 18.10.2021" reads as under :-

" सुना पत्रावली का अवलोकन किकया।

पुन�ीक्षणकता� के द्वा�ा प्रार्थ�ना पत्र अन्तर्ग�त धा�ा 156 (3) द०प्र०सं० में मुख्य रूप से यह कर्थन किकया र्गया है किक विवपक्षीर्गण के द्वा�ा भूमिम संख्या 1145 �कबा 0.2400 हे 0 में पुन�ीक्षणकता� का 1/6 अंश अर्था�त 0.40 हे० भूमिम को बिबना किकसी अधिधका� के हिदनांक 13.06.2018 को विवपक्षी संख्या 7 महाबी� के पक्ष में जरि�ये मुख्ता�आम पंजीकृत विवलेA से विवक्रय क� हिदया र्गया। जबकिक विवपक्षीर्गण के द्वा�ा अपने द्वा�ा पूव� में नफीस Aां व ताहिह� अली के पक्ष में बिबक्रय की र्गयी भूमिम में बैनामे की चौहद्दी में पू�ब त�फ पुन�ीक्षणकता� के हिहस्से को स्वीका� किकया र्गया। इस प्रका� विवपक्षीर्गण के द्वा�ा बिबना किकसी अधिधका� के पुन�ीक्षणकता� के उक्त भूमिम को विवपक्षी संख्या 7 के पक्ष में बिबक्रय क�के र्गम्भी� क्षनित पहुंचायी र्गयी है। इस बैनामे के आधा� प� हिदनांक 01.09.2020 को विवपक्षीर्गण संख्या 1 ता 7 मौके प� आक� कब्जा क�ने लर्गे औ� जब पुन�ीक्षणकता� ने उन्हें मना किकया तो ये लोर्ग पुन�ीक्षणकता� को जान से मा�ने की धमकी हिदया।

विवद्वान अव� न्यायालय के द्वा�ा उक्त प्रक�ण को विवमिशष्ट रूप से मिसविवल प्रकृजिक्त का वाद पाते हुए उसे निन�स्त क� हिदया र्गया।

पुन�ीक्षणकता� के द्वा�ा उपयु�क्त विवधिध व्यवस्र्था Mा० लक्ष्मण में विवनश्चनियत विवधिध व्यवस्र्था प� बल देते हुए यह तक� प्रस्तुत किकया र्गया किक यहिद प्रा�म्भ से ही बैनामा मिलAे जाने के समय से ही बिबक्रेता के मन में छल क�ने की भावना र्थी औ� वह उसी से वशीभूत होक� कोई फज1 बैनामा किकया है तो ऐसी जिस्र्थनित में मामला मिसविवल प्रकृनित का होने के बावजूद उसमें दाजिLMक काय�वाही प्रा�म्भ की जा सकती है।

पत्रावली प� पुन�ीक्षणकता� के द्वा�ा र्गाटा संख्या 1145 �कबा 0.040 हे० भूमिम का Aतौनी कार्गज संख्या 5 र्ग /8 प्रस्तुत किकया र्गया है। इस भूमिम प� पुन�ीक्षणकता� का तनहा नाम दज� है। पुन�ीक्षणकता� के द्वा�ा पत्रावली प� र्गाटा संख्या 1145 में �कबा 0.040 हे० प� विवपक्षी घनश्याम के नाम दज� Aतौनी भी प्रस्तुत की र्गयी है। इन प्रपत्रों

से यह प्रकट है किक र्गाटा संख्या 1145 में पुन�ीक्षणकता� का अंश 0.040 हे० है औ� शेष विवपक्षीर्गण 1 ता 6 का भी अंश इस र्गाटा में निनहिहत है। पत्रावली प� प्रश्नर्गत बिबक्रय विवलेA हिदनांकिकत 13.06.2018 की प्रनित कार्गज संख्या 5 र्ग /18 लर्गायत 5 र्ग /30 संलग्न है जिजसमें क्रेता महावी� मिसंह विवपक्षी संख्या 7 के पक्ष में विवक्रेतार्गण सुजीत कुमा� , र्गोपाली , हेमनार्थ आहिद ने र्गाटा संख्या 1145 का जुज भार्ग पू�ब 73 किफट पजिश्चम 73 किफट उत्त� 16 किफट 10 इंच व दक्षिक्षण 23 किफट 2 इंच भूमिम बेची र्गयी है।

उपयु�क्त तथ्यों से स्पष्ट है किक विवपक्षी संख्या 1 ता 6 र्गाटा संख्या 1145 के सहभूमिमध� हैं औ� उनके द्वा�ा सहभूमिमध� होते हुए विवक्रय विवलेA हिदनांकिकत 13.06.2018 में अपनी भूमिम विवक्रय क�ने का कर्थन किकया र्गया है। जब तक किकसी सक्षम न्यायालय का काई निनण�य पारि�त न हो जाए तब तक इस तथ्य का निनधा � ण नहीं किकया जा सकता किक बिबक्रय विवलेA हिदनांकिकत 13.06.2018 से बिबक्रेतार्गण के द्वा�ा अपने हिहस्से की भूमिम बेची र्गयी है अर्थवा किकसी अन्य के हिहस्से की।

धा�ा 397 द०प्र०सं० में यह प्राविवधानिनत है किक पुन�ीक्षण न्यायालय को आलोच्य आदेश में शुद्धता वैधता या औधिचत्य के बा�े में समाधान क�ना होता है।

माननीय उच्च न्यायालय ने सम्मानिनत विवधिध व्यवस्र्था र्थ�मैक्स मिल० एवं अन्य बनाम के० एम० जानी (2012) 2 एस सी सी 650 एवं इन्द्रा मोहन र्गोस्वामी एवं अन्य बनाम उत्त�ांचल �ाज्य एवं अन्य 2008 (1) जे आई सी 737 सुप्रीम कोट� में माननीय उच्चतम न्यायालय ने यह विवनिनश्वयन किकया किक यहिद न्यायालय के समक्ष प्रस्तुत प्रार्थ�ना पत्र से मात्र मिसविवल प्रकृनित का वाद परि�लक्षिक्षत होता है तो न्यायालय को ऐसे प्रकृनित के प्रार्थ�ना पत्रों के आधा� प� दांडिMक काय�वाहिहयां प्रा�म्भ नहीं क�ना चाहिहए। दाजिLMक न्यायालय को सचेत �हना चाहिहए किक सामान्यतः आम जनमानस लोर्गों को प्रताडिdत क�ने हेतु दाजिLMत न्यायालयों में किकसी भी आधा� प� प्रक�ण प्रा�म्भ क�ते हैं औ� दूस�े पक्ष से अपनी शत्रुता एवं वैमनस्यता के आधा� प� प्रताडिdत क�ते हैं।

हस्तर्गत मामले में जब तक किकसी सक्षम मिसविवल न्यायालय के द्वा�ा यह तथ्य विवनिनश्चनियत न हो जाए किक जान बूझक� छल एवं प्रवंचना कारि�त क�ने हेतु सम्पूण� तथ्यों का संज्ञान �Aते हुए विवपक्षीर्गण के द्वा�ा पुन�ीक्षणकता� की भूमिम को विवपक्षी संख्या 7 को विवक्रय विवलेA से विवक्रय किकया र्गया है तब तक इस मामले में दाजिLMक काय�वाही हेतु कोई भी वाद हेतुक उत्पन्न नहीं होता है।

उप�ोक्त समस्त विववेचना से स्पष्ट है किक विवद्वान मजिजस्ट्रेट के द्वा�ा पुन�ीक्षणकता� के द्वा�ा प्रस्तुत साक्ष्यों से पत्रावली में अधिhम अhसारि�त क�ने का कोई उधिचत आधा� नहीं पाया र्गया है। विवद्वान मजिजस्ट्रेट के द्वा�ा पत्रावती की समीक्षा क�के उपयु�क्त निनष्कष� प� पहुंचा र्गया है जिजसमें मे�े द्वा�ा कोई अवैधानिनकता नहीं पाया जाता है।

सम्मानिनत विवधिध व्यवस्र्था अमिमत कपू� बनाम �मेश चन्द्र (2012) 9 एस सी सी 460 सुप्रीम कोट� में यह विवनिनश्चयन किकया र्गया है किक पुन�ीक्षण न्यायालय को मात्र उन्हीं परि�जिस्र्थनितयों में आलोच्य आदेश में हस्तक्षेप क�ने की अनुमनित है जब किक आलोच्य आदेश बिबना किकसी साक्ष्य व का�ण के औ� बिबना विवधिधक प्राविवधानों के मनमानेपूण� ढंर्ग से पारि�त किकया र्गया हो। पुन�ीक्षण न्यायालय को यह अधिधका� नहीं है किक वह बिबना उपयु�क्त परि�जिस्र्थनितयों के आलोच्य आदेश में हस्तक्षेप क�ते हुए अपना अमिभमत प्रनितस्र्थाविपत क� देवे।

माननीय उच्चतम न्यायालय के द्वा�ा सम्मानिनत विवधिध व्यवस्र्था शभीमा फारूAी बनाम शाहिहद Aान (2015) 5 एस सी सी 705 में विवनिनश्चयन किकया र्गया किक यहिद मजिजस्ट्रेट के द्वा�ा मिलया र्गया दृजिष्टकोण त्रुहिटपूण� नहीं है एवं उसमें वैधानिनकता व विवधिधक शुद्धता का अभाव नहीं है तो पुन�ीक्षण न्यायालय ऐसे आलोच्य आदेश को अपास्त नहीं क� सकता है।

उपयु�क्त समस्त तथ्यों से स्पष्ट है किक आलोच्य आदेश हिदनांकिक 20.01.2021 में विवद्वान मजिजस्ट्रेट के द्वा�ा जिजस प्रका� से पत्रावली प� उपलब्ध तथ्यों व साक्ष्यों की समीक्षा क�के आदेश पारि�त किकया र्गया है , उसमें कोई अवैधानिनकता अशुद्धता व औधिचत्यहीनता नहीं है।

अतः दाजिLMक पुन�ीक्षण निन�स्त किकये जाने योग्य है। "

Challenging the impugned orders, it is stated that a perusal of the contents of the application under Section 156(3) Cr.P.C. preferred by the applicant indicates that cognizable offense is made out and as such, the learned court was under obligation to direct the concerned Police personnel to lodge an F.I.R., which is the spirit of the judgment passed by the Hon'ble Apex Court in the case of XYZ Vs. State of M.P. and Ors., reported in 2023 (1) JIC 538 (SC) and Lalita Kumari Vs. State of U.P. reported in (2014) 2 SCC 1.

Considered the submissions of learned counsel for the applicant, learned A.G.A., who supported the impugned orders, and perused the records.

It would be apt to indicate that after considering various judgments, this Court in the judgment passed in the case of Bare Lal Pandey Vs. State Of U.P. Thru. Its Addl. Chief Secy. Home Deptt. Lko. And Others (APPLICATION U/S 482 No. - 5716 of 2024, Neutral Citation No. - 2024:AHC-LKO:45169) on 03.07.2024 observed as under:-

"21. Regarding expression 'investigation', it would be appropriate to refer the paras 53 to 55 of the judgment passed in the case of Kailash Vijayvargiya (supra), which reads as under :

"Relevant legal provisions of Chapter XII of the Criminal Procedure Code, 1973.

53. The Code vide Chapter XII, ranging from Section 154 to Section 176, deals with information to the Police and their power to investigate. Section 154 deals with the information relating to the commission of a cognizable offence and fiats the procedure to be adopted when prima facie commission of a cognizable offence is made out. Section 156 authorises a police officer in-charge of a Police station to investigate any cognizable offence without the order of a Magistrate. Sub-section (3) of Section 156 provides for any Magistrate empowered under Section 190 to order an investigation as mentioned in Section 156(1). In cases where a cognizable offence is suspected to have been committed, the officer in-charge of the Police station, after sending a report to the Magistrate empowered to take cognizance of such offence, is entitled under Section 157 to investigate the facts and circumstances of the case and also to take steps for discovery and arrest of the offender. Clauses (a) and (b) of the proviso to sub-section (1) to Section 157 give discretion to the officer in-charge not to investigate a case, when information of such offence is given against any person by name and the case is not of serious nature; or when it appears to the officer in-charge of the Police station that there is no sufficient ground for entering the investigation. In each of the cases mentioned in clauses (a) and (b) to the proviso to sub-section (1) to Section 157, the officer in-charge of the Police station has to file a report giving reasons for not complying with

the requirements of sub-section (1) and in a case covered by clause (b) to the proviso, also notify the informant that he will not investigate the case or cause it to be investigated. Section 159 gives power to a Magistrate, on receiving such report of the officer in-charge, to either direct an investigation or if he thinks fit, proceed to hold a preliminary inquiry himself or through a Magistrate subordinate to him, or otherwise dispose of the case in the manner provided by the Code.

54. Sections 160 to 164 deal with the power of the Police to require attendance of witnesses, examination of witnesses, use of such statements in evidence, inducement for recording statement and recording of statements. Section 165 deals with the power of a Police officer to conduct search during investigation in the circumstances mentioned therein.

55. The power under the Code to investigate generally consists of following steps : (a) proceeding to the spot; (b) ascertainment of facts and circumstances of the case; (c) discovery and arrest of the suspected offender; (d) collection of evidence relating to commission of offence, which may consist of examination of various persons, including the person accused, and reduction of the statement into writing if the officer thinks fit; (e) the search of places of seizure of things considered necessary for investigation and to be produced for trial; and (f) formation of opinion as to whether on the material collected there is a case to place the accused before the Magistrate for trial and if so, taking the necessary steps by filing a chargesheet under Section 173."

22. Even in the judgment passed in the case of XYZ (supra) referred by learned counsel for the applicant, the Hon'ble Apex Court in para 23 has observed as under:

"It is true that the use of the word "may" implies that the Magistrate has discretion in directing the police to investigate or proceeding with the case as a complaint case. But this discretion cannot be exercised arbitrarily and must be guided by judicial reasoning."

In view of aforesaid, this Court is of the view that if investigation in the matter is not required then in that eventuality, the Magistrate/Court of competent of jurisdiction can treat the application under Section 156(3) Cr.P.C. as a 'complaint case'. As per settled view, the Magistrate/ Court of competent of jurisdiction, after verifying the truth and veracity of the allegations made in the application under Section 156(3) Cr.P.C., can (i) pass an order contemplated by Section 156(3) Cr.P.C., (ii) direct examination of complaint and witnesses and proceed further in the manner provided by Section 202 Cr.P.C. and (iii) can also direct the preliminary inquiry by police in terms of law laid down in the judgment passed in the case of Lalita Kumari (supra). The Magistrate/Court of competent of jurisdiction is also empowered to reject the application under Section 156(3) Cr.P.C.."

Upon due consideration of the observations made by the learned Magistrate and the Revisional Court in the orders impugned dated 20.01.2021 and 18.10.2021, as also various the pronouncements on the issue including the judgment passed by the Hon'ble Apex Court in the case of Kailash Vijayvargiya Vs. Rajlakshmi Chaudhari, (2003) SCC

OnLine SC 569 and Bare Lal Pandey Vs. State Of U.P. (Supra) as also the expression "Investigation", as indicated under Section 2(h) of the Cr.P.C. (now repealed) and 2(l) of the BNSS, 2023, this Court finds no force in the present application. It is for the following reasons :-

(i) According to the Hon'ble Apex Court converting a civil dispute into a criminal dispute should not be permitted. In the instant case the dispute relates to Gata No. 1145/0.040 Hectare, situated at Village-Sarai Subedar, Kasba- Safipur, District-Unnao. The applicant and the private opposite party Nos. 2 to 8 are co-sharer of the property in issue, i.e. Gata No.1145/0.040 Hectare.

(ii) In the facts, as alleged by the applicant, to the view of this Court, no investigation by the police is required.

For the aforesaid reasons, the instant application has no force. It is, accordingly, dismissed. Cost made easy.
