Heard learned counsel for the applicant and the learned Additional Government Advocate.

The present petition has been filed with the following prayer:

"For the facts, reasons, and circumstances mentioned in the accompanying affidavit, it is most respectfully prayed that this Hon'ble court may kindly be pleased to quash the charge sheet dated 8/11/2023 arising out of case crime no. 03 of 2020 under Sections 384, 420, 166, 120 B, IPC and Section 7 of PC Act at police station SIT District Lucknow; and the summoning order dated 9/2/2024 passed by Learned Special Judge (PC Act)/CBI (Central), Lucknow, in Case No. 1399 of 2023, State versus Dharampal Singh and others; and the entire proceedings of Criminal Case No. 1399 of 2023, State v. Dharampal Singh and others, arising out of the aforesaid charge sheet dated 8/11/2023, so far as it relates to the applicant, contained as Annexure Nos. 1 and 2 to the application."

Learned Counsel for the applicant submitted that on the basis of imaginary facts, the FIR of the case in question was lodged, and in the confessional statement of the co-accused, the involvement of the applicant

has been shown. He further submitted that a charge sheet has also been submitted against the applicant under section 7 of Prevention of Corruption Act and sections 384, 420, 166, and 120 B, IPC. He also submits that in the entire case diary, not even a single complainant was interrogated by the investigating officer, therefore, no offense is made out.Learned counsel for the applicant also relied on a judgment of this court in Application U/S 482 No. 11678 of 2023, Ram Gopal Gupta v. State of UP and others, dated December 14th, 2023.

Learned Additional Government Advocate requested some time to seek instructions in the matter.

On the next date, some responsible officer of the SIT shall appear before this court along with the complete case diary and inform the details of the complainant/victim.
