On 22.09.025 the following order was passed-

“Supplementary affidavit filed today by the learned counsel for the applicant is taken on record.

The contention put forth by the learned counsel for the applicant is that the parties have settled their dispute by way of entering into compromise deed on 11.7.2022; a copy of which is appended along with the supplementary affidavit. She submits that in fact, the original copy of the compromise deed was given to the S.H.O. concerned but the same has not been filed along with the charge sheet before the trial court. She added that the applicant is suffering for his no fault even after settlement is done between the parties, which is permissible under law.

On the other hand, learned counsel for the State has made objection that in absence of the original compromise deed, the same cannot be directed to be verified by the trial court.

for the parties, it transpires that photo copy of the compromise deed dated 11.7.2022 is appended along with the supplmentary affidavit. To verify the fact, presence of the opposite party no.2 is required, therefore, rather referring the matter to the trial court, it would be appropriate to call opposite party no.2 before this Court.

In view of the aforesaid, the opposite party no.2 Rajesh Kumar is directed to appear before this Court on 15.10.2025 at 2.15 pm.

The counsel for the applicant shall inform this order to the opposite party no.2 and at the same time, learned A.G.A. shall also inform this order through the S.H.O. concerned.

The applicant is directed to fetch bank draft of Rs.5,000/- on the date fixed, in the name of the opposite party no.2/informant.

Let notice be issued to the opposite party no.2 returnable at an early date.

Steps be taken within two weeks.
