Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Instant application under Section 482 Cr.P.C./ 528 B.N.S.S. has been filed with the prayer to direct the learned trial court i.e. the learned Civil Judge (J.D.) F.T.C/Judicial Magistrate Ambedkar Nagar to take appropriate action to trace on record the First Information Report of Case Crime No.44/2012, Under section- 498-A, 323, 504, 506 of the Indian Penal Code & Sections ¾ of the Dowry Prohibition Act pertaining to Police Station- Mahila Thana, District- Ambedkar Nagar and proceed with trial of Case No.9382/2020 [Old Case No. 2188/2013] (State Versus Afzal Guddu) pending before him.

Learned counsel for the applicant has submitted that the matter is pending consideration since the year 2013 and on the either pretext, the matter is being adjourned. He has shown the order-sheet wherein, since 20.11.2021, the office clerk was directed to place the copy of the FIR, which is untraceable yet and more than 20 orders have been passed by which the matter is being extended.

In view of the above, the District Judge, Ambedkar Nagar was directed to submit a report before this Court, by seeking explanation, from the Presiding Officer concerned.

In pursuance of the aforesaid order, District and Sessions Juge,

Ambedkar Nagar submitted a report dated 25.09.2025 and informed that original FIR and complaint is already placed on the record on 16.12.2024 by the concerned clerk. The trial of the case is going on as the witnesses are not appearing.

At this stage, learned counsel for the applicant requested that the petition may be disposed of with the direction to the learned trial court to conclude the trial expeditiously.

Accordingly the petitioner petition is disposed of with the direction to the learned trial Court expeditiously as the trial in the case in question is pending since 2013.

¶20

It is expected from the court concerned to conclude the trial in accordance with law.
