Heard learned counsel for the petitioner and learned A.G.A. for State-respondent.
Instant application has been filed seeking following main relief:
"to quash the impugned summoning order dated 05.01.2023 issued by Presiding Officer, Additional Court No.05, Lucknow in Complaint No.115815/2022, Veer Sen versus Aman Beg, alongwith entire proceeding of aforesaid complaint case, pending before the Additional Court No.05, Lucknow, as contained in Annexure No.1 to this petition in the interest of justice."
It is stated that the applicant is ready to settle the dispute by way of mediation and to show the bona fide, in this regard, a draft of Rs. 3,00,000/- in favour of Krishna Rawat has already been obtained from the HDFC bank, a photo copy of which is annexed at page-80.
Considering the aforesaid, this court directs the Station House Officer, Police Station - Indira Nagar, District - Lucknow (in short "SHO") to inform opposite party no.2/Krishna Rawat W/o Bhoop Narayan Rawat, resident of A-1429/14, A-Block, Indira Nagar, Lucknow, who is presently residing at House No.28, Krishna Vihar, Near Mansa Green Tiraha, Police Station-Indira Nagar, Lucknow regarding the date fixed in the matter as also the intention of the applicant.
List on 22.09.2025.
On the date of listing, applicant shall appear in person.
Learned AGA is directed to communicate this order to SHO, who shall file the affidavit of service upon opposite party no. 2 on or before the next of listing.
