Counsel for the applicant submits that he had challenged the revisional court order by filing Criminal Revision No.2954 of 2011. The Court vide order dated 24.08.2011, stayed the operation of the order dated 06.07.2011. Thereafter the criminal revision was dismissed for want of prosecution on 11.12.2015. After that the trial court proceeded and passed the order dated 28.11.2024, the same has been challenged in the present 482 Cr.P.C. application.

Counsel for the applicant further submits that after dismissal of the revision for want or prosecution, he has moved restoration application on 07.11.2019 and the same is pending. He next submitted that during pendency of the recall application, the trial court should not decide the case on merit.

Put up this case, after two weeks, as fresh.
