Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Present application has been filed with the prayer to quash the impugned judgment and order dated 9.5.2025 passed by learned Additional Sessions Judge/F.T.C.-II, Bahraich in Criminal Revision No.385/2024 (Lalji Sahu Versus State of U.P. & Another) as well as impugned summoning order dated 22.8.2024 passed by learned Additional Civil Judge/Additional Chief Judicial Magistrate, Bahraich in Complaint Case No.33519/2023 (Ravi Tiwari Versus Lalji Sahu) under Section - 138 Negotiable Instrument Act, Police Station- Payagpur, District- Bahraich.

Learned counsel for the applicant submitted that the prosecution is a result of some monitory dispute between the applicant and private respondent and there might be possibility of settlement of dispute if the matter be referred to Mediation and Conciliation Centre of this Court.

Learned A.G.A. has no objection on the matter being referred to the Mediation and Conciliation Centre of this Court.

Considering the submissions of learned counsel for the parties, going through the contents of application as well as other relevant documents, as it is evident that the prosecution is a result of some monitory dispute, therefore, possibility of settlement cannot be ruled out.

List this case on 24.07.2025.

Issue notice to private respondent returnable at an early date.

On the next date, applicant as well as private respondent shall appear in person before this Court.

Applicant is directed to deposit Rs.50,000/- (Fifty thousand rupees) before the Senior Registrar of this Court within a period of two weeks from today.

On the next date, with the consent of both the parties, order shall be passed for referring the matter to the Mediation and Conciliation Centre of this Court.

Till the next date, no coercive steps be taken against the applicant.
