Allahabad High Court (Jitendra Kumar Sinha, J.), decision dated September 19, 2025, allowed an application under Section 482 Cr.P.C. (Application U/S 482 No. 43683 of 2024) filed by Manjoor Ali and 5 others seeking quashing of the chargesheet dated 17.9.2023 (State vs. Manjoor Ali and others), arising out of Case Crime No. 0405 of 2022, under Sections 419, 420, 467, 468, 471, 504, 506 IPC, P.S. Geeda, District Gorakhpur, and the cognizance order dated 9.7.2024. A compromise dated 4.2.2023 had been arrived at between the applicants and opposite party no. 2 and was verified by the learned Court concerned, its report being on record; opposite party no. 2 and the State raised no objection. On a mention being made by the learned counsel for the applicants, case has been taken up.

Supplementary affidavit filed by the learned counsel for the applicants is taken on record.

Heard Mr. Naushad Alam, holding brief of Sri Om Praksh, learned counsel for the applicant d and Mr. Arvind Prabodh Dubey, learned counsel for the opposite party no. 2 and Sri Ashish Kumar Tripathi, learned AGA for the State respondents.

This application under Section 482 CrPC has been preferred for quashing the chargesheet dated 17.9.2023 (State vs. Manjoor Ali and others), arising out of Case Crime No. 0405 of 2022, under Sections 419, 420, 467, 468, 471, 504, 506 IPC, P.S. Geeda, District Gorakhpur as well as cognizance order dated 9.7.2024 on the basis of compromise dated 4.2.2023.

It is contended by the learned counsel for the applicants that the applicants and the opposite party no. 2 have entered into compromise and the same has been verified by the learned Court concerned and a report regarding the same is on the record. It is also submitted that in view of the compromise arrived at between the applicant and opposite party no. 2, proceedings of the aforesaid case be quashed against the applicant.

On the other hand, learned counsel for the opposite party no. 2 and learned AGA for the State have no objection to the above submissions made by the learned counsel for the applicant.

In view of the fact that the applicant and opposite party no. 2 have entered into compromise and the said compromise has been verified by the learned Court concerned and a report regarding verification of compromise is on record and keeping in view of the law laid down by Hon'ble Supreme Court in the case of State of Madhya Pradesh vs. Laxmi Narayan and others, AIR 2019 SC 1296 and the facts of the matter, it would be in the interest of justice that the impugned proceedings be quashed in respect of the applicant. It was stated that in view of these facts and circumstances, no useful purpose would be served by keeping the impugned proceedings pending and thus, the impugned proceedings may be quashed on the basis of compromise arrived at between the parties.

In view of the aforesaid, the entire proceeding of chargesheet dated 17.9.2023 (State vs. Manjoor Ali and others), arising out of Case Crime No. 0405 of 2022, under Sections 419, 420, 467, 468, 471, 504, 506 IPC, P.S. Geeda, District Gorakhpur as well as cognizance order dated 9.7.2024 on the basis of compromise dated 4.2.2023 are hereby quashed.

The application under Section 482 Cr.P.C. stands allowed .
