Heard Shri Tarun Kumar Sharma, learned counsel for the applicants and Sri S.K. Singh, learned AGA for the Staterespondent.

This application under Section 482 Cr.PC. has been filed by the applicants to quash the entire proceedings of Criminal Appeal No.89 of 2012 (Veerpal and others Vs. Smt. Maya and others), under Sections 452, 323 IPC pending before the court of learned Additional District and Sessions Judge, Court no. 9, Ghaziabad.

Learned counsel for the applicants submits that so far as the applicant no. 1 is concerned, he is the father of Pooja, applicant no. 2 is the uncle and applicant no. 3 happens to be the friend of applicant nos. 1 and 2. Learned counsel for the applicants submits that though there was certain criminal cases lodged between the parties, however, the applicants faction withdrew the cases but the opposite party no. 2 has not withdrawn the cases and she is reciling from her commitment. Learned counsel for the applicants submits that a direction be issued to the court below to decide the said proceedings in accordance with law.

Learned AGA submits that the prayer which is being sought to be canvassed might be innocuous but it is a matter between the

parties and this Court would not interfere at this stage, particularly, when there is allegations of reciling from the commitment.

Having heard the learned counsel for the parties and I do not think fit to quash the proceedings, however, liberty is accorded to the applicants to take necessary steps as permissible and advisable under law.

With the aforesaid observation, the application stands disposed off .
