Harkesh and 4 Others Vs State of Up and Another

This is an application filed under Section 482 of the Cr.P.C. for quashing the entire proceedings of Complaint Case No. 162 of 2023 under sections 498-A, 323, 504 and 506 IPC & 3/4 D.P. Act, Police Station Iglas, District Aligarh (Smt. Reshma Vs Harikesh and others).

On 22.11.2024 the following order has been passed:-

1. Heard Sri Dharmendra Kumar Rajput, learned counsel for the applicants and Sri Uday Bhan, learned AGA for the State.

2. The present application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding of Complaint Case No. 162 of 2023, under Sections 498-A, 323, 504, 506 IPC and 3/4 D.P. Act, Police Station Iglas, District Aligarh.

3. Contention of learned counsel for the applicants is that the present matter is matrimonial dispute and the same can be amicably settled through mediation proceeding and a request is made to refer this case to Mediation and Conciliation Centre of this Court.

4. Issue notice to the opposite party no. 2, returnable at an early date.

¶15

In view of the above, it is directed that applicants shall deposit a sum of Rs. 25,000/- within 10 days from today with the Mediation Centre of this Court out of which Rs. 20,000/- shall be paid to opposite party no. 2, on the date fixed, for her appearance before the Mediation Centre and Rs. 5000/- be retained by the Mediation Centre as mediation fee.

6. The matter is remitted to the Mediation Centre with the direction that after deposit

of such amount, by the applicants, it shall issue notice to the parties fixing some date for mediation and shall make all possible efforts to conclude the mediation and conciliation proceedings expeditiously, preferably within a period of two months.

7. List this case in the week commencing 20.01.2025 before the appropriate Bench along with the report of Mediation Centre.

8. After depositing Rs.25,000/- before mediation centre, the receipt of the same shall be submitted by the applicants before the court below. In case, such receipt of deposit is filed before the court below then, no coercive action shall be taken against the applicants in the aforesaid case, till next date of listing.

9. In case, the applicants fail to submit the receipt of deposit before the court below then court below will be free to proceed in the matter.

It is made clear that in case there occurs default by the applicants either in depositing the amount or in appearing before the Mediation Centre on the date fixed, the interim order shall cease to operate and the Mediation Centre shall immediately communicate with the office which in turn shall list the case within a week before the appropriate Bench for passing orders in the matter.

Learned counsel for the applicants has submitted that there happens to be settlement agreement dated 15.05.2025 between the parties settling the dispute before the Mediation and Conciliation Centre, Allahabad, para-7 of the Settlement Agreement is quoted hereinunder:-

7. अंतिरम समझौता िदनांक 03.04.2025 के अनुसार वादकािरयों के मध्य आज िनम्निलिखत समझौता सम्पन्न हुआ है:-

क. यह िक िदनांक 03.04.2025 को हुए अंतिरम समझौता के अनुसार पक्षकार सौहादर् एंव स्नेह पूवर्क बतौर पित-पत्नी के रूप में रह रहे है एंव आज मध्यस्थ के समक्ष उपिस्थत हैं और कथन करते हैं िक आगे भी वे दोनों पूणर् सौहादर् और स्नेह पूवर्क साथ-साथ रहेंगें तथा वैवािहक जीवन के दाियत्वों का िनवार्हन करेंगे तथा एक दूसरे का सम्मान करेंगे।

ख. यह िक पित आश्वस्त करता है िक वह अपनी पत्नी का पूरा ध्यान रखेगें एवं उनकी सभी जरूरतों और आवश्यकताओं को पूणर् करेगें तथा श्रीमती रेशमा (पत्नी) ने भी यह स्वीकार िकया है िक यह भी अपने पित का ध्यान रखेंगी एवं अपने िजम्मेदािरयों का िनवार्ह करेंगी।

ग. यह िक दोनों पक्षकार ऐसा कोई कायर् नहीं करेंगे िजससे िकसी भी पक्ष को मानिसक या शारीिरक रूप से ठेस पहुंचे और वे अपनी गितिविधयों से एक-दूसरे को संतुष्ट करने का प्रयास करेंगे।

घ. यह िक पक्षकारों के मध्य इस बात पर भी सहमित बनी है िक वे शांितपूणर् और सौहादर्पूणर् माहौल में रहकर

उिचत व्यवहार करेंगे।

ङ. यह िक दोनों पक्षकारों के पिरवारजन/सगे-संबंधी दोनों के शांितपूणर् वैवािहक जीवन में अनावश्यक हस्तक्षेप नहीं करेंगे।

च. यह िक दोनो पक्ष एक दूसरे के िवरुद्ध पंजीकृत/िवचाराधीन समस्त वादो को उिचत उपाय करते हुआ वापस समाप्त करा लेंगे।

छ. यह िक दोनो पक्षकार एक दूसरे के िखलाफ, इस वैवािहक वाद के संदभर् में कोई नया वाद दायर नहीं करेंगे।"

Learned counsel for the applicants submits that once the parties have amicably settled the dispute there is nothing remains to be further proceeded with.

Looking into the over all facts situation as well as the the parties have mediated and following the judgement of Hon'ble Apex Court in Gian Singh v. State of Punjab and another 2012 (10) SCC 303 and State of Madhya Pradesh v. Laxmi Narayan, (2019) 5 SCC 688 , the proceedings are liable to be quashed.

Accordingly, the application is allowed .

The proceedings of Complaint Case No. 162 of 2023 under sections 498A, 323, 504 and 506 IPC & 3/4 D.P. Act, Police Station Iglas, District Aligarh (Smt. Reshma Vs Harikesh and others) be quashed.
