Heard Mr. Sandeep Kumar Maurya, the learned counsel for applicant and the learned A.G.A. for State-opposite party-1.

Perused the record.

3.Applicant-Angad Kushwaha, who is a charge sheeted accused, has approached this Court by means of present application under Section 482 Cr.P.C. with the following prayer:

"It is therefore most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the instant Criminal Misc. Application under Section 482 Cr.P.C. and quash the impugned order dated 02.07.2024 passed by learned Chief Judicial Magistrate Court No. 17, Deoria whereby proceeding under Section 82 Cr.P.C. has been initiated against applicant in pursuance of Case Crime No. 39 of 2024 under Section 302 I.P.C. Police Station- Salempur, District- Deoria and further the applicant may be granted at least 3 months time to appear before Court below for applying his bail.

It is further prayed that during the pendency of this Criminal Misc. Application the further proceeding of under Section 82 Cr.P.C. may be stayed, or may pass any other and further order which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case otherwise applicant shall suffer irreparable loss and injury.."

At the very outset, the learned counsel for applicant submits that applicant does not wish to press this application any further. He therefore submits that this application be dismissed as withdrawn.
