Heard Shri Ankit Agarval, learned counsel for the applicants and Shri Jyoti Kumar Singh, learned A.G.A. for the State. 2. The instant application under Section 482 Cr.P.C. has been filed for quashing the charge sheet dated 22.03.2019, cognizance order dated 16.04.2019, as well as entire proceedings of Criminal Case No. 5763 of 2019 titled State v. Hemant Rauhtela and another, arising out of Case Crime No. 76 of 2019, under Section 7/25/35 of Arms Act, registered at P.S. Sector-58, District Gautam Buddh Nagar, pending trial in the Court of Chief Judicial Magistrate, Gautam Buddh Nagar.

The facts, in brief, are that an FIR being Case Crime No. 0064 of 2019, under Section 394, 411 I.P.C., was registered at P.S. Sector58, Commissionerate Gautam Buddh Nagar on 03.02.2019 at the behest of Prakash Yadav-Sub Inspector working in the U.P. Police alleging the loot of his licensed pistol while he had gone with relatives and friends to attend the engagement ceremony of his maternal uncle's son at Muradnagar. On returning, they decided to have dinner in the middle of the night at Shanker Dhaba, where he had scuffled with some unknown persons sitting next to his table, and someone snatched his government pistol bearing no. 1645807910, along with live cartridges. The FIR was lodged against unknown persons, as the person involved in the assault were not known to the complainant, S.I. Prakash Yadav. The names of Hemant Rautela, Abhishek Bhatt, Rahul

Chawala and Dushyand Veer Singh surfaced during investigation, and consequently, a charge sheet was filed against them. After filing the charge sheet, the matter was compromised between the complainant and the accused persons named above vide the compromise deed dated 30.05.2023, and the co-ordinate Bench of this Court quashed the proceedings vide order dated 07.11.2023 passed in Application U/s 482 No. 41201 of 2023. On examination of the compromise deed, it’s revealed that both the parties to the FIR were friends and known to each other prior to the commission of the offence; besides other terms. In fact, the terms of the compromise, are self-explanatory and contradictory with respect to the prior acquaintance is concerned qua accused with the complainant.

During the pendency of the investigation of the FIR dated 3.2.2019, S.I. Pratap Singh registered another FIR bearing Case Crime No. 0076 of 2019 on 12.02.2019, almost nine days after the registration of the first FIR. The looted pistol was shown to have been

recovered from the dashboard of a car driven by Hemant Rautela, and the other petitioners were stated to have been sitting in the car, as per impugned FIR dated 12.2.2019.

Based on the compromise dated 30.05.2023 filed in FIR No.64/2019 u/s 394, 411 IPC registered at P.S. Sector-59 NOIDA, and with a submission that the impugned FIR is impermissible in law and misuse of the power of police, with the additional arguments that the recovered pistol is the case property of the FIR dated 3.2.2019, and therefore, no separate/impugned FIR is permissible, the applicants are implicated on false facts and had prior acquaintance with the complainant SI Pratap Singh and the same fact has been concealed by him at the time of registration of both the FIRs.

In the given facts-circumstances, three facts prima-facie emerge: (i) the complainant had prior acquaintance with the applicants before registration of the FIR dated 3.2.2019 and the complainant had registered the FIR based on engineered facts, (ii) the compromise dated 30.5.2023 is containing contradictory statements with respect to the prior acquaintance of the complainant with the applicants, who happens to be Sub Inspector in Uttar Pradesh Police, and (iii) both the FIRs are registered on the complaint of SI Pratap Singh posted at P.S. Sector-15 NOIDA Gautam Budh Nagar within seven days, at a place of his posting. So far as the allegations of the impugned FIR No.0076 of 2019 dated 12.2.2019 are concerned, this Court has strong suspicion at first glance that the same is based on concocted facts and is an attempt to cover up misdeeds that had occurred on or before registration of first FIR dated 3.2.2019.

In such circumstances, the Commissioner of Police, Gautam Buddh Nagar is directed to conduct a 360⁰ fact-finding inquiry about the registration of the above referred FIRs and the complainant's relationship with the applicants. The applicants' professional and

social profile may also be inquired into. A report in this regard be sent to this Court on or before the next date of hearing.

Shri Jyoti Kumar Singh learned that A.G.A. may take instructions on the merits of the case.

Notice be issued to opposite party no.2. Steps be taken accordingly.

The petitioners, namely, Hemant Rautela, Abhishek Bhatt, Rahul Chawala, and the complainant of the first FIR, S.I. Shri Prakash Yadav, are directed to appear in person before this Court on the next date of hearing i.e. 27.01.2025.
