आवेदकगण मोहन शमा� एवं अ�य की ओर से धारा 482 दं०�०सं० के अ�तग�त यह आवेदन प�, पिरवाद सं. 25/2014 अ�तग�त धारा 498ए/ 323 भा०दं०िव० एवं धारा 3/4 दहेज �ितषेध अिधिनयम, थाना पचदेवरा, िजला हरदोई के जूडीिसयल मिज��ेट, हरदोई क� सं. 01 , �ारा पािरत �सं�ान/तलबी आदेश िद० 16.06.2014 के िव�� दायर िकया गया।

आवेदकगण के िव�ान अिधव�ा एवं िव�ान अपर शासकीय अिधव�ा रिव �ीवा�तव को सुना तथा प�ावली का पिरशीलन िकया।

आवेदकगण के िव�ान अिधव�ा के तक� को �वणोपरा�त, प�ावली के पिरशीलन से �यायालय ने पाया िक पिरवाद म� लगाए गए आरोप एक सं�ेय अपराध के कािरत होने का खुलासा करते ह� और वह आरोप 200 व 202 दं.�.सं. के बयान से पिरलि�त होता है। उन आरोप� को इस �यायालय �ारा धारा 482 दं०�०सं० के तहत अपनी शि� का �योग करते �ए, बयान और आरोप� की शु�ता और िव�सनीयता का आकलन करने की आव�यकता नह� है। इस �तर पर आवेदकगण के िववािदत बचाव पर िवचार नह� िकया जा सकता है। त�नुसार उपरो� वाद की काय�वाही को र� करने की �ाथ�ना और पिरणामी काय�वाही अ�वीकृत की जाती है।

इस �तर पर, आवेदकगण के िव�ान अिधव�ा का अनुरोध है िक आवेदकगण को अभी तक उपरो� मामले म� िगरफ्तार नह� िकया गया है और पुिलस आवेदकगण को िगरफ्तार करने के �यास म� है, और संबंिधत अवर �यायालय �ारा आवेदकगण के िखलाफ द�डा�मक �ि�या जारी की जा सकती है, इसिलए आवेदकगण के जमानत आवेदन प� पर िवचार करने के िलए संबंिधत अवर �यायालय को िनद�श जारी कर िदया जाय।
