The present application under Section 482 Cr.P.C (now Section 528 B.N.S.S) has been preferred with the following main prayer :-

"To quash /set aside the impugned charge sheet dated 15.01.2015 as well as impugned summoning order dated 09.04.2015 passed by Gangster Judge/Additional Session Judge, Sultanpur relating to Gangster case no. 06/2015, case crime no. 114/2013, Under Section2/3 (1) U.P. Gangsters and Anti-Social Activities (Prevention) Act, Police Station-Kotwali Dehat, District-Sultanpur, State of U.P. Versus Rajibuddin and others so far relates to the petitioner only and further it may be pleased to stay the impugned charge sheet dated 15.01.2015 as well as impugned summoning order dated 09.04.2015 passed by Gangster Judge/Additional Session Judge, Sultanpur relating to Gangster case no.6/2015, case crime no. 114/13, Under Section-2/3 (1) U.P.Gansters and Anti Social Activities (Prevention) Act, Police StationKotwali Dehat, District-Sultanpur, State of U.P. Versus Rajibuddin and others"

Learned counsel for the applicant, after arguing at some length has submitted that the present application may be disposed of with liberty to the applicant to move a discharge application before the court concerned and if any such application is moved, the same may be decided expeditiously.

As such, the present application under Section 482 Cr.P.C is disposed of with liberty to the applicant to move a discharge application before the court concerned and the court below is directed to decide the application moved by the applicants, expeditiously, in accordance with law.
