Heard Shri Babul Kumar Sharma, learned counsel for the applicants, Shri Rahil Kumar Kaushik, Advocate, holding brief of Shri Roopesh Srivastava, learned counsel for the opposite party no. 2 and Shri B.P. Maurya, learned A.G.A. for the State.

This application under Section 482 Cr.P.C. has been preferred to quash the entire proceedings as well as summoning order dated 02.02.2023 passed by Additional Chief Judicial Magistrate/Civil Judge (Senior Division)/F.T.C., Jhansi in Criminal Case No. 1597 of 2023 (State Vs. Bhaiyyan @ Jafar Kureshi and Another) arising out of Case Crime No. 45 of 2022, under sections 379/411 I.P.C., Police Station-Baruasagar, District Jhansi, pending in the court of Additional Chief Judicial Magistrate/Civil Judge (Senior Division)/F.T.C., Jhansi in pursuance of compromise deed dated 22.04.2023 held between the parties.

Learned counsel for the applicants argued that the parties have entered into compromise, which is dated 22.04.2024, copy of the said compromise is annexed as Annexure no. 4 of the application. It is further submitted that proceedings of the aforesaid case may be quashed on the basis of compromise arrived at between the parties.

On the other hand, counsel for the opposite party no. 2 and learned AGA for the State have no objection to the above submissions of learned counsel of the applicants.

In view of the above, it is directed that if the opposite party no. 2 and applicants have appeared before the court below within three weeks from today for verification of the aforesaid compromise, the court below shall verify the compromise in the presence of both the parties and submit a compromise verification report to this Court, within three weeks thereafter.

Learned counsel for the applicants may also file a supplementary affidavit bringing on record the proceedings of the compromise, within two weeks, after verification of the compromise.

List this case on 10.10.2025, before the appropriate Bench.

¶19

Interim order, if any, granted earlier, shall continue till the next date of listing.
