Heard learned counsel for the applicants and learned A.G.A. for the State.

This application u/s 482 Cr.P.C. has been preferred against order dated 17.05.2024, passed by Civil Judge (S.D.) / F.T.C., Hamirpur in Case No. 800 of 2012 (Smt. Vimla Devi Vs. Chetram and others), P.S.- Sumerpur, District- Hamirpur, pending in the court of Civil Judge (S.D.) / F.T.C., Hamirpur.

It is submitted by learned counsel for the applicants that regarding an incident dated 29.12.2011 the opposite party no.2 has lodged a first information report against applicants for offences under Sections 323, 498A IPC and Section 3/4 D.P. Act. Regarding same matter, opposite party no.2 has lodged the complaint case against applicants. Applicants have filed an application under Section 482 Cr.P.C. challenging the proceedings of said complaint case, wherein by order dated 19.11.2012 further proceedings of complaint case were stayed till the next date but said interim order could not be extended further. It was submitted that applicants have filed an application under Section 210 Cr.P.C. before the trial Court for consolidation of complaint case with state case but that application has not been decided so far.

In view of aforesaid, learned trial Court is directed to decide the application dated 21.08.2024 filed by applicants-accused under Section 210 Cr.P.C. expeditiously in accordance with law. It is further directed that till the disposal of said application, no coercive action shall be taken against the applicants, provided the applicants cooperate in early disposal of said application.

The application u/s 482 Cr.P.C. is disposed of with aforesaid observations.
