Heard Mr. Suresh Dhar Dwivedi, the learned counsel for applicant and the learned A.G.A. for State-opposite party-1.

Perused the record.

Applicant- Shashi Verma Alias Shashi, has approached this Court by means of present application under Section 482 Cr.P.C. with the following prayer:-

"It is, therefore, MOST RESPECTFULLY PRAYED that this Hon'ble court may graciously be pleased to directed the court below no taken any coercive action against the applicant in Session Trial No.436 of 2003 (New S.T. No.35 of 2009) (State Vs. Rishiram and others) arising out of case crime no.34 of 2003, u/s. 302 I.P.C., P.S. Sadar Bazar, District Shahjahanpur, pending in the court of Additional Session Judge, Court No.13, Shahjahanpur.; otherwise the applicant shall suffer an irreparable loss and injury. And/or pass such other and further order which this Hon'ble court may deem fit and proper under the present facts and circumstances of the case."

After some arguments, the learned counsel for applicant fairly submits that he be permitted to withdraw the present application with liberty to file fresh with better particulars details and with proper relief.

Learned A.G.A. for State-opposite party-1 has no objection to the prayer made by the learned counsel for applicant.

In view of above, this application is, accordingly, dismissed as withdrawn, with liberty aforesaid.

application shall be returned to the learned counsel for applicants after obtaining photocopies of the same to be kept on record.
