The applicant sought setting aside of (i) the order dated 25.07.2024 of the Additional District & Session Judge, Court No. 21, Agra rejecting his Criminal Revision No. 300 of 2024 - arising out of a Section 138 N.I. Act complaint (Complaint Case No. 241 of 2020, P.S. Etmadaula, District Agra) - for his failure to take steps for issuance of notice, and (ii) the order dated 06.11.2024 of the Special Judge 138 N.I. Act, Agra issuing a non-bailable warrant against him, together with directions to decide the revision on merit and to remand for a fresh order after considering the material on record. The Court noted that the revision stood rejected precisely because the applicant had not taken steps for issuance of notice, counsel having stated in the revisional court that the applicant was not interested in taking such steps; the applicant claimed the statement was made without his instructions. Heard learned counsel for the applicant and learned A.G.A. for the State.

The present application has been filed by the applicant for setting aside the impugned order dated 25.07.2024 passed by court of Additional District & Session Judge, Court No. 21, Agra in Criminal Revision No. 300 of 2024 (Narendra Kumar Vs. State of U.P. and others) under Section 138 N.I. Act, Police Station Etmadaula, District Agra and to set aside the order dated 06.11.2024 passed by Special Judge 138 N.I. Act, Agra in Complaint Case No. 241 of 2020, Police Station Etmadaula, District Agra, thereby non-bailable warrant has been issued against the applicant and all consequential proceeding thereon and to direct the Revisional Court to decide the Criminal Revision on merit and also remand back the present case before the court below to pass afresh order in accordance with law after considering the material evidence on record.

The revision of the applicant has been rejected since steps have not been taken by the applicant for issuance of notice on the other side. The statement was made by learned counsel for the applicant before the revisional court that applicant is not interested in taking steps for issuance of notice to opposite party no. 2 in the revisional proceedings and as such the case has been rejected. Learned counsel for the applicant further submits that no such instructions were given to the applicant and the statement made by the applicant before the revisional court was incorrect.

On a query being made to learned counsel for the applicant whether any complaint was made under the Advocates Act for misconduct against the Advocate who was appearing in the revisional proceedings, learned counsel for the applicant submits that no complaint has been made. Learned counsel for the applicant has neither before this Court any cause has been shown as to why steps were not being taken for issuance of notice nor the order issuing notice has been placed before this Court.

Accordingly, the application filed under Section 482 Cr.P.C. is dismissed.
