Case called out. None appears for the applicant. Learned A.G.A. is present.

Vide order dated 10.1.2025 the following order with an stipulation that in case the deposit is not made the interim protection granted vide order dated 10.1.2025 shall stand withdrawn, has been passed by this Court:-

"Heard learned counsel for the applicant and learned A.G.A. Learned counsel for the applicants submits that the dispute between the petitioner and respondent No.2 is likely to be settled in Mediation & Conciliation Centre of this Court in case it is referred to it.

In view of the above, let notice be issued to respondent No.2. The petitioner and respondent No.2 shall appear before the Mediation & Conciliation Centre of this Court on 4.2.2025. The petitioner, as agreed on his behalf by learned counsel, shall deposit a sum of Rs.30,000/- in Mediation Centre of this Court which shall be released in favour of respondent No.2 in three equal consecutive instalments as and when he appears before the Mediation Centre. The Mediation Centre of this Court shall submit a report within three months thereafter to this Court. Till the next date of listing, the impugned order dated 27.6.2022, passed by ACJM-I, Gonda in complaint case No.120158 of 2017 Vinod Kumar Singh vs. Mohd. Mohammad Saleem and another shall remain stayed.

It is made clear that in case the deposit is not made, as directed above, interim protection granted vide this order shall stand withdrawn. List on 5.5.2025."

It is borne out from the record that the neither money, as directed by this Court, has been deposited by the applicant nor he is present to press this application. It appears that he is not interested in pursuing this case.

Accordingly, the application is dismissed for want of prosecution.
