Heard learned counsel for the petitioner. Notice on behalf of the respondent No.1 has been accepted by the office of the Chief Standing Counsel.

In view of the order proposed to be passed by this Court, notice to the private-respondents is dispensed with.

By means of the instant petition, the petitioner seeks expeditious disposal of his regular suit bearing Civil Suit No.267/2016 pending in the Court concerned since 2016.

It is alleged that the defendants of the suit are not cooperating and till date the issues have not been framed.

Having considered the aforesaid and without entering into the merits of the case, this Court disposes of the petition with liberty to the petitioner to move an appropriate application before the Court concerned, who will be required to take note of it and pass appropriate orders in accordance with law. It is apparently unpalatable that in a suit of the year 2016, the pleadings have not yet been exchanged so as to arrive at a situation for framing the issues. In such circumstances, the Court concerned is required to look into this aspect also.

With the aforesaid, the petition is disposed of .
