Heard learned counsel for the parties and perused the record.

By means of the present petition under Article 227 of the Constitution of India the petitioner has prayed for issuing a direction to the learned Additional District & Sessions Judge/ Special Judge, P.C. Act, Court No.7, Lucknow to decide the miscellaneous case no.284/2018 (State vs. Sanjeev Mishra) pending before it expeditiously within stipulated period.

Learned counsel for the petitioner submits that the said miscellaneous case has been filed under section 3 (h) (4) National Highway Act before the Court concerned by Smt. Malti Mishra wife of Late Subodh Mishra for Land Acquisition compensation in respect of plot no.764 ka and kha, area 0.169 hectare.

Written arguments have already been filed but private respondent is not appearing before the Court and the case is adjourned from one to other date without substantial progress.

Matter is pending since year 2018.

After the death of Sanjeev Mishra his mother Smt. Malti Mishra wife of late Subodh Mishra has been substituted on record.

The petitioner has purchased the property from late Malti Mishra and after on the basis of the sale deed the petitioner is owner of the property in question.

He has been impleaded by orders of the Court dated 29.4.2025 on his application under Order 1 Rule 10 CPC read with section 151 CPC.

Written arguments are filed by the petitioner but case is still pending at the stage of arguments.

The petitioner is third party in the said miscellaneous case no.284/2018 relating to land acquisition reference. The original parties are delaying the disposal of the case to the detriment of the petitioner.

Keeping in view the limited prayer made in the present petition it has been submitted that in petition filed by Malti Mishra matters under Article 227 No.6047 of 2024 this Court has issued direction to the court concerned that as matter is pending since year 2018, the same be decided within a period of two months from the date of production of certified copy of this order before him.

In view of the above and taking into consideration the limited prayer made in the petition, it is directed that the court concerned shall make every effort to decide the said miscellaneous case no.284 of 2018 expeditiously say within a period of three months from the date a certified copy of this order is produced before him.

With the aforesaid directions, writ petition is disposed of .
