Heard learned counsel for the petitioner as well as learned Standing Counsel for the State respondent.

2.In view of the proposed order notice to private respondent is dispensed with.

Instant petition has been filed by the petitioner praying for direction to the respondent No.1- Tehsildar, Tehsil- Jalalpur, District Ambedkar Nagar to decide case No.5211/2023, computerized case No.T202304040205211 (Reeta Devi Vs. Dan Bahadur) under Section 34 of U.P. Revenue Code pending since 31.10.2023, expeditiously.

Learned counsel for the petitioner submits that grievance of the petitioner would be sufficiently met in case respondent no. 1 considers and decides the aforesaid case in the time bound manner.

Learned Standing Counsel has no objection to the aforesaid prayer.

Considering the facts and circumstances of the case, without entering into the merits, respondent no.1 - Tehsildar, Tehsil- Jalalpur, District Ambedkar Nagar is desired to make all endeavor to decide case No.5211/2023, computerized case No.T202304040205211 (Reeta Devi Vs. A copy of the order sheet indicates that on all the dates fixed there is call for boycott given by local bar association and accordingly the court cannot be faulted for keeping the matter pending. Accordingly, aforesaid direction has been issued subject to the condition that the petitioner shall appear on all the dates fixed and in case they do not appear then the benefit of this order shall not be available to him. It is, therefore, directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances. Counsel for the petitioner undertakes that he shall cooperate in expeditious disposal of the case, failing which the benefit of this order shall not be available to the petitioner.
