This writ petition has been filed with the following prayer:-

"i) Issue a order or direction in the nature of mandamus commanding the Special Judge (SC/ST Act), Mirzapur to decide the Misc. Civil Appeal No. 17 of 2023 (Executive Engineer, Electricity Distribution Division-II, Purvanchal Electricity Distribution Division Fathan, District Mirzapur Versus Amit Kumar Tripathi and others), pending before him within stipulated time."

It is contended by learned counsel for the petitioner that against the award dated 26.06.2023, misc. appeal has been preferred which is pending consideration before Special Judge (SC/ST Act), Mirzapur. The sole prayer made in the writ petition is for expeditious disposal of the Misc. Civil Appeal No. 17 of 2023.

As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Special Judge (SC/ST Act), Mirzapur to decide the Misc. Civil Appeal No. 17 of 2023 (Executive Engineer, Electricity Distribution Division-II, Purvanchal Electricity Distribution Division Fathan, District Mirzapur vs. Amit Kumar Tripathi and others), in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order.

With the aforesaid directions, writ petition stands disposed of.

It is made clear that this Court has not adjudicated the matter on merits.
