Neelam Devi challenged, under Article 227 of the Constitution, (i) the order dated 04.11.2024 of the Civil Judge (Junior Division), Gonda in Original Suit No. 385 of year 2005 ('Anganu vs Smt. Brij Kumari') rejecting her temporary injunction application, and (ii) the order/judgment dated 09.07.2025 of the Additional District Judge/Special Judge (POCSO Act), Gonda dismissing her Civil Appeal No. 56 of year 2024 brought against the former. यािचकाकतीर् के िवद्वान अिधवक्ता श्री उमेश चन्द्र तथा िवपक्षी के िवद्वान अिधवक्ता श्री राजेन्द्र प्रसाद यादव को सुना व पत्रावली का अवलोकन िकया।

भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त प्रस्तुत इस िरट यािचका द्वारा यािचकाकतीर् ने िसिवल जज अवर खण्ड गोण्डा द्वारा मूल वाद संख्या 385 वषर् 2005 में पािरत आदेश िदनांक 04.11.2024 की वैधता को चुनौती दी है िजसके द्वारा यािचकाकतीर् का अस्थायी िनषेधाज्ञा प्राथर्ना-पत्र िनरस्त कर िदया गया है। आदेश 04.11.2024 की वैधता को चुनौती देते हुए यािचकाकतीर् ने प्रकीणर् िसिवल अपील संख्या 56 वषर् 2024 प्रस्तुत की जो िवद्वान अपर जनपद न्यायाधीश/िवशेष न्यायाधीश (पॉक्सो एक्ट), गोण्डा में िनणर्य तथा आदेश िदनांक 09.07.2025 के माध्यम से िनरस्त कर दी तथा अपीलीय आदेश की वैधता को भी इस यािचका के माध्यम से चुनौती दी है।

प्रश्नगत संपित्त पर िवपक्षी एक पंजीकृत वसीयत िदनांक 31.05.2000 के माध्यम से अपना स्वािमत्व का दावा करते हैं िजसकी वैधता को यािचकाकतीर् ने वाद के माध्यम से चुनौती दी है।

यद्यिप यािचकाकतीर् के िवद्वान अिधवक्ता ने यािचका के समथर्न में िवस्तृत तकर् िकए हैं, िकतु अंततः उन्होंने इस अनुतोष के िलए अपने तकर् सीिमत िकए िक िवचारण न्यायालय मूल वाद को शीघ्रतापूवर्क िनस्तािरत करें तथा मूल वाद के िनस्तारण तक िवपक्षी प्रश्नगत संपित्त पर िकसी तृतीय पक्ष के अिधकारों का सृजन न करें।
