यािचकाकतार् के िवद्वान अिधवक्ता श्री जय प्रकाश िसह को सुना तथा पत्रावली का अवलोकन िकया।

भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने अितिरक्त िसिवल जज (प्रवर खण्ड), कक्ष संख्या 42, लखनऊ को मूल वाद संख्या 1464 सन 2020, िजसका नया पिरवितत नंबर 2064 सन 2021 है, के शीघ्र िनस्तारण का िनदेर्श िदये जाने का अनुरोध िकया है।

उपरोक्त वाद िवपक्षी ने यािचकाकतार् की माँ श्रीमती गंगा देवी के िवरुद्ध प्रस्तुत िकया गया था िजसमें स्थायी िनषेधाज्ञा की आज्ञिप्त मांगी गयी थी। िदनांक 01.10.2020 को वाद में एकपक्षीय अस्थायी िनषेधाज्ञा आदेश पािरत हो गया। िदनांक 19.03.2021 को यािचकाकतार् अपनी मृत माँ के स्थान पर प्रितस्थािपत हुआ। आदेश-पत्र के अवलोकन से प्रतीत होता है िक िदनांक 23.05.2025 को वाद अंतिरम िनषेधाज्ञा प्राथर्ना-पत्र के िनस्तारण हेतु िनयत था िकन्तु वादी ने सुनवाई का स्थगन चाहा। िदनांक 08.07.2025 को पक्षों की सहमित से िवचारण न्यायालय ने वाद िबन्दु िवरिचत िकये तथा यािचकाकतार् द्वारा प्रस्तुत प्रितदावे पर भी वाद िबन्दु िवरिचत िकये गये एवं प्रारंिभक वाद िबन्दुओं का िनस्तारण हुआ।

आदेश-पत्र की प्रित से यह प्रतीत होता है िक वाद की कायर्वाही अनेक ितिथयों को वादी की अनुपिस्थित के कारण स्थिगत हुई है तथा अनेक ितिथयों को अिधवक्तागण के न्याियक कायर् से िवरत रहने के कारण भी वाद की सुनवाई नहीं हो पायी है।

जबिक, वाद वषर् 2020 से लंिबत है; वाद िबन्दु िवरिचत िकये जा चुका हैं एवं स्थायी िनषेधाज्ञा प्रभावी है, ऐसी पिरिस्थित में वाद का शीघ्र िनस्तारण पक्षों के िहत में एवं न्यायिहत में होगा।
