Heard learned counsel for the petitioner.

By means of the instant petition, the petitioner seeks expeditious disposal of his Regular Suit No.1121 of 2019 pending before the respondent.

Having considered the aforesaid and noticing the extracts of the order sheets, which have been brought on record as Annexure no.2 which indicates that five issues were framed on 30.10.2021. Thereafter, the matter is fixed for several dates and it is the allegation of the petitioner that respondent (the plaintiff of the suit) is lingering the matter by seeking adjournments.

Since the suit is of the year 2019, this Court is not inclined to entertain the petition, however, liberty is available to the petitioner to move an appropriate application bringing the grievance to the notice of the Court and in case such an application is moved the Court shall consider and dispose of it noticing the dictum of this Court in Prabhat Narain Tickoo v. Mrs Mamta and others; 1988 SCC Online All 327.

With the aforesaid, the petition is disposed of .
