In view of the order proposed to be passed by this Court, notice to the private-respondents is dispensed with.
The present petition has been filed for the following main relief:-
"Wherefore it is most respectfully prayed that this Hon'ble court may graciously be pleased to direct the opposite party no. 3 Nayab Tehsildar Raunahi Tehsil Sohawal District Ayodhya to consider and decide the restoration application dated 24-11-2023 in computerized case no. T201804230200667, Ram kumar vs Smt. Prabha Dei under section 34 of U.P. Revenue code 2006 The copy of restoration application dated 24-11-2023 is being annexed here with as annexure no. 1 to this petition."
Taking note of the fact that recall application in mutation case is pending since 24.11.2023 and also that the case related to mutation of name(s) in revenue records should be decided expeditiously, being summary in nature, the present petition is disposed of with direction to the respondent No.-3 to consider and decide the pending recall application dated 24.11.2023, in Case No. T201804230200667, (Ram kumar vs Smt. Prabha Dei), after affording full opportunity of hearing to the parties, but without granting any unnecessary adjournment, preferably within three months from the next date fixed before it, if there is no other legal impediment in this regard.
It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law.
With the aforesaid, the petition is disposed of.
