Heard learned counsel for the petitioner as well as learned A.G.A. for the State and perused the record.

The present petition under Article 227 of the Constitution of India has been filed with the prayer to direct the learned court below to expedite and conclude the trial of Case No.1200 of 2023 pending before the Court concerned, i.e., Additional Principal Judge IV, Family Court, District - Lucknow.

Learned counsel for the petitioner submits that he does not want to press the prayer no.1(a) & 1(d).

4. Prayer is allowed.

Learned counsel for the petitioner further submits that application under Section 125 Cr.P.C. was filed, which was registered as Case No.510 of 2012 (Smt. Sita Yadav & Anr. Vs. Sanjay Yadav) before the competent court, which was finally decided on 22.3.2023 but direction of the competent court was not complied with. Thereafter, application under Section 128 Cr.P.C. now 147 B.N.S.S. was filed before the competent court, which was registered as Case No.1200/2023 but the same is also not being decided despite this fact that respondent has put in appearance, therefore, kind indulgence of this Court is necessary for issuing a direction to the competent court for expedite disposal of the said case.

Learned A.G.A. has no objection, in case, a direction for expeditious disposal of the case has been issued.

Considering the arguments of learned counsel for the parties and going through the records, learned court below is directed to decide the case of the petitioner bearing Case No.1200 of 2023, within a period of three months, in accordance with the law.

With the aforesaid direction, the present writ petition is disposed of .
