Heard Sri Ashok Kumar Maurya, learned counsel for the petitioners and Sri Raj Bux Singh learned Additional Chief Standing Counsel for the State.

By means of the instant writ petition filed under Article 226 of the Constitution of India, the petitioners have sought issuance of a direction for restraining interference in his peaceful possession for the property i.e. gata no. 2779 measuring 0.7510 hectares and gata no. 2758 measuring 0.3090 hectares situated at village Para Pargana district-Lucknow.

The petitioners have already filed a suit i.e. Suit No. 1762 of 2015 for perpetual injunction in which an interim order has been passed on 21.10.2023. Learned Civil Judge(Junior Division), Lucknow has issued a direction to the police authorities on 18.7.2024 for ensuring compliance of the temporary injunction order dated 21.10.2023.

A copy of the report dated 5.9.2024 submitted by the Sub-inspector of police Station-Para Commissionerate, Lucknow addressed to the learned Civil Judge(Junior

Division), Hawali, district-Lucknow have been annexed with the writ petition wherein the police has reported that the spot was inspected after receipt of a copy of the order passed by the court and it was found that a three feet high wall existed on the land in dispute and further construction has been stopped.

Thus, it appears that that the police has already taken appropriate steps for implementation of the temporary injunction dated 21.10.2023. The suit is already pending and the petitioners have liberty to approach the civil court for any further orders.

The writ petion is accordingly disposed of.
