Heard learned counsel for petitioner, learned State Counsel for opposite party No.1, Mr. Ravi Singh learned counsel for opposite party No.2 and Mr. Anakh Shukla learned counsel for opposite party No.3.

Petition has been filed challenging office memorandum dated 24th January, 2024 so far as it relates for a direction to the institution concerned for re-applying of no objection certificate pertaining to conduct of the B Pharma Course for academic session 2024-25.

Learned counsel for opposite parties on the basis of instructions submits that although the petitioner institution had earlier applied in June for the aforesaid no objection certificate but the same could not be granted for various grounds and subsequently due to the notification of government order dated 5th January, 2024, all such institutions who had earlier also applied were required to apply afresh. It is submitted that the aforesaid notification as well as notification dated 9th January 2024 were uploaded on the website but this facility was not availed of by the petitioner institution and due to the cut off date of 31st January,2024 having already expired, no relief could be granted to petitioner.

In view of such objection being raised learned counsel for petitioner submits that the petitioner institution may be granted liberty to apply fresh for next academic session, which even otherwise is available to petitioner.

In view of aforesaid, the petition is consigned to record.
