1. Rejoinder affidavit filed by learned counsel for the petitioner to the counter affidavit filed by respondent nos.2 to 6, is taken on record.
2. Heard Shri Piyush Asthana, learned counsel for the petitioner, learned State Counsel for State-respondent no.1 and Shri Aishwarya Pratap Singh, learned counsel for respondent nos.2 to 6.
3. Learned counsel for the petitioner has submitted that petitioner is undertaking the fifth semester/ year in the course of Doctor of Pharmacy being conducted in the Amity University. It is submitted that he had earlier filed Writ C No.7842 of 2024, seeking re-evaluation of his answer sheets pertaining to the fifth semester course, since he was indicated as having 'failed' in the said semester.
4. The aforesaid writ petition was disposed of vide order dated 11.09.2024, in terms of undertaking given by the University that the internship of the petitioner would be continued and would be subject to outcome of re-evaluation/ recheck of the answer sheets of the aforesaid fifth semester.
5. Learned counsel for the petitioner submits that even after reevaluation the petitioner has been shown as having not been promoted to the sixth semester.
6. Learned counsel for the petitioner has also adverted to the fact that in earlier years also petitioner has been indicated as having been promoted in semester 1 to 4, but subsequently has been shown as not been promoted in the said semester.
7. Learned counsel appearing for the respondent nos.2 to 6, on the basis of instructions and counter affidavit, submits that the status of petitioner indicating him not been promoted in semester 1 to 4 is only indicative of the academic performance in the last/ final exam and does not have any reference to his earlier academic performance in which he has already cleared, semester 1 to 4.
8. It is also submitted that re-evaluation of petitioner's fifth year exam papers was conducted by an independent person at Noida.
9. Since the aforesaid revaluation papers are not on record, learned counsel for the opposite party nos.2 to 6 is granted a week's time to produce the same.
10. List this case on 16.12.2024 at 2.15 p.m. for production of the aforesaid revaluation papers in sealed cover.
