Sri Manish Mishra, Additional Chief Standing Counsel says that there is a dilapidated structure existing on the land in question and the land is not recorded in the name of the petitioner but in the name of Mahboob Ur Rahman and others as tenure holders. The petitioner and others were attempting to undertake constructions on the said land of a Masjid without proper sanction and in this process they were attempting to include Pipal tree and Chabutra existing nearby within its boundary, which created social/ communal tension in the area.
Let affidavit be filed by the opposite parties within three weeks.
