Heard learned counsel for the petitioner. Notice on behalf of the respondents No.1 to 4 has been accepted by the office of Chief Standing Counsel. Shri Pankaj Gupta, learned counsel has accepted notice for the respondent No.5.
A preliminary objection regarding maintainability of the petition has been raised by the learned standing counsel as well as learned counsel for the Gaon Sabha and it is urged that the petitioner had earlier preferred a petition bearing Writ Petition No.5/2023 under Article 227 of the Constitution of India (Ram Manorath v. Tehsildar & Others) which was not entertained by a Coordinate Bench of this Court by means of the order dated 04.01.2023.
It is urged that for the same relief, the instant petition is also not maintainable coupled with the fact that the prayer which has been sought is also not available to the present petitioner.
At this stage, learned counsel for the petitioner submits that he does not wish to press the instant petition.
In view of the aforesaid, the petition is dismissed as not pressed .
