Heard learned counsel for the petitioner, learned Counsel appearing for the Nagar Nigam and learned standing counsel for respondent no. 1.

This writ petition has been filed with the following main prayer:-

" (i). issue a writ, order or direction in the nature of mandamus commanding the opposite party nos. 2 to 4 to make payment of arrear of rent of the vehicle due from December 2019 to June 2020 to the petitioner."

The vehicle no. U.P. 41 AR7575 Bolero Jeep of the petitioner was attached with Nagar Nigam, Lucknow on a monthly rent of Rs.16,500/- p.m. w.e.f. December, 2019 up to June, 2020. The respondents are not disputing that certain arrears need to be paid amounting to Rs.1,50,000/but they keep on pending the same saying that they do not have the money to make the payment.

Let a counter affidavit be filed, sworn by respondent no. 3, indicating as to why payment is not being made to the petitioner although it is admitted that arrears are due and as to within how much time, the said payment shall be made.

List on 18.09.2024 as fresh showing the name of Shri Savitra Vardhan Singh, as counsel for the respondents.
