Heard learned counsel for the petitioner, learned Standing Counsel appearing on behalf of opposite parties no.1 and 2 and Shri Prasoon Kumar Rai, learned counsel appearing on behalf of opposite parties no.3 and 4.

This petition has been filed with the following main prayer :-

"to issue a writ, order or direction in the nature of mandamus thereby commanding the opposite party no.3 to ensure the compliance of the order dated 13.7.2024 passed by the District Magistrate, Pratapgarh in compliance of the order dated 19.03.2024 whereby decided the representation of the petitioner with a direction to the opposite party no.3 to pay the compensation to the petitioner under the Scheme of "Samajwadi Kisan Evam Sarvahit Beema Yojna", as contained in Annexure No.2 to this writ petition."

It is the case of the petitioner that even though her claim was decided in her favour but the insurance company has not paid the amount.

The counsel appearing for the Insurance Company has placed before this Court copy of the information downloaded from the website of the Consumer Forum and it has been stated that for the same relief as claimed in this petition the petitioner has filed a complaint case no :- CC/5/2019 on 03.01.2019 which is pending and the date of next hearing in the matter is 05.9.2024.

Counsel for the petitioner says that no case has been filed by the petitioner.

Let counter affidavit be filed by the State - respondents and by the opposite parties no.3 and 4 within four weeks. Two weeks' time thereafter is granted to the learned counsel for the petitioner for filing rejoinder affidavit.
