Heard learned counsel for the petitioner, learned Standing Counsel, who appears on behalf of the State-respondents and Sri Dilip Kumar Pandey, learned counsel, who appears on behalf of the Gaon Sabha.
This writ petition has been filed with the following main prayer :-
"i) Issue a writ, order or direction in the nature of the Mandamus whereby directing the concerned authorities specifically to the opposite party no.2 and 3 to ensure that opposite party no.6 shall pay all dues forthwith which is unpaid."
It has been submitted by the learned counsel for the petitioner that the petitioner is the Ex. Pradhan of Village-Kinhauti Development BlockSandila, District-Hardoi. He had, during his tenure as Pradhan, got certain constructions done of Panchayat Bhawan and Khandaja and sanitary works etc., details of which have been given in the writ petition, for which he has not received any payment despite several applications made in this regard through various authorities. An enquiry was also done in the matter and the District Panchayat Raj Officer, has been directed to make an enquiry against the current/sitting Pradhan by the office of the District Development Officer, Hardoi by his letter dated 06-03-2023, but, nothing has been done for making payment to the petitioner.
Learned Standing Counsel has produced before this court the instructions sent by the Block Development Officer,Sandila, district-Hardoi, wherein, it has been stated that the payment has been made of all constructions done and the certain constructions, which the petitioner claims
to have raised, were not found and therefore, the payment regarding such non existing constructions, has not been done.
Let Counter Affidavit be filed by the respondents within four weeks.
Two weeks' time thereafter is given to the petitioner to file Rejoinder Affidavit.
