Heard learned counsel for the petitioners, learned Standing Counsel who appears on behalf of State - respondents.

This petition has been filed with the following main prayers:-

"(a) issue a writ, order or direction in the nature of Certiorari to quash the impugned order dated 08.7.2024 passed by the Block Development Officer, Block Biswan, District Sitapur to recover the amount released in favour of the petitioners for construction of house under scheme of Pradhan Mantri Awaas Yojna Gramin, U.P. as contained in Annexure No.11 to this writ petition.

(b) issue a writ, order or direction in the nature of Mandamus to direct the authorities concerned to release the remaining amount forthwith to complete the construction of the house of the petitioners lying in dilapidated condition, in the interest of justice."

The counsel for the petitioners has made allegations against the local MLA of Vidhan Sabha Constituency 'Seuta' at whose behest an inquiry was instituted regarding eligibility of beneficiaries of 'Pradhanmantri Gramin Awas Yojana'.

The petitioners have not impleaded the said local MLA in person as a party in the writ petition.

Let an appropriate impleadment application be filed within a week by the learned counsel for the petitioners.

The respondents are directed to file the counter affidavit within four weeks. Two weeks' time thereafter is given to the petitioners to file rejoinder affidavit.

List this case on 11.9.2024. In the meantime the inquiry that has been instituted on 23.7.2024 by the BDO Biswa, Sitapur shall be completed and copy of such inquiry report shall be filed along with counter affidavit of the respondents.
