Heard learned counsel for the petitioner, Shri Rahul Shukla, learned Additional Chief Standing counsel appearing on behalf of respondent Nos.1 to 8 as well as Shri Dilip Kumar Pandey, learned counsel appearing on behalf of respondent No.9.
With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally decided.
The instant petition has been filed contending that the petitioner has filed a complaint against the pradhan under the provisions of UP Panchayat Raj (Removal of Pradhan, Up-Pradhan and Members) Enquiry Rules, 1997 (hereinafter referred to as "Rules, 1997) which is still pending for consideration before the competent authority.
Responding to that, Shri Rahul Shukla, learned Additional Chief Standing counsel on the basis of instructions sent by the District Panchayat Raj Officer, Lakhimpur Kheri dated 20.01.2024 informs that on the basis of the complaint sent by the petitioner, an Enquiry Officer has been appointed under Rule 2(c) of the Rules, 1997 to enquire into the said complaint and enquiry would be taken to its logical conclusion.
