- Heard Shri Anil Srivastava, learned counsel for petitioner, Shri Ajit Kumar, learned counsel for respondent no. 1 & 2, learned Standing Counsel appearing for respondent nos. 4 and 5 and perused the material available on record.
- By means of the present writ petition, the petitioner has challenged the order dated 31.01.2024 passed by the learned Permanent Lok Adalat, District Lucknow in P.LA. No. 208 of 2018 where the petitioner has been directed to pay compensation for the death of brother of resondent nos. 1 to 3 under the provisions of Mukhyamantri Kissan Evam Sarvahit Beema Yojna (MKSBY).
- The main contention of learned counsel for petitioner is that the respondent nos. 1 to 3/claimants are elder brothers of deceased and consequently, are not covered under the aforesaid policy and hence, they are not entitled to receive the compensation. The learned Permanent Lok Adalat while passing the aforesaid impugned judgment and order has relied upon the Government Order dated 21.08.2017 wherein it has been clearly held that the legal heirs of the deceased will be entitled to receive the compensation under the aforesaid scheme.
