Heard Shri Arunendra Nath Mishra, learned counsel for the petitioner as well as Ms. Pushpila Bisht, appearing on behalf of the respondents no. 2 and 3, Kendriya Vidyalay Sangathan.

The present dispute arises with regard to the admission of the child of the petitioner to Class - I in Session 2024-25 in Kendriya Vidyalay, Aliganj, Lucknow. It has been submitted by counsel for the petitioner that the petitioner had completed all the formalities and submitted online application for admission in Class - I in Kendriya Vidyalay, Aliganj, Lucknow. On 22.04.2024 a provisional list of selected candidates for document verification was also published where the name of the ward of the petitioner was placed at Serial No.76 in the General Category. The petitioner claims that he is entitled to be considered and giving preference under the Central Government Employee : as the father of the petitioner retired from Post of Postal Assistant.

Ms. Pushpila Bisht, appearing for the Kendriya Vidyalay Sangathan has opposed the present writ petition and has submitted that in Kendriya Vidyalay, the preference is given to the children of transferable and non-transferable Central Government Employee and children of ex-servicemen. She submits that as per admission guidelines, the petitioner does not fall under Clause (A) (1), inasmuch as he is a retired Central

Government Employee and is not an ex-serviceman. She further submits that under Clause (B), only the Kendriya Vidyalayas under the Public Sector Undertakings/Institute of Higher Learning Sector, the children and grandchildren of the employees of the Project Sector/Institutes of Higher Learning which are the sponsors of the Vidyalaya are given preference. She submits that the present Kendriya Vidyalay does not fall under the category of Kendriya Vidyalay under Public Sector undertakings and hence, even under Clause (B), the petitioner can not be given any preference.

In the aforesaid circumstances, this Court is of the considered view that the petitioner cannot be considered under Clause (A) as he is not a child of Central Government Employee and under Clause (B) because the said Kendriya Vidyalay is not under the Public Sector Undertakings. Accordingly, the direction as sought by the petitioner cannot be granted as it does not fall into the criteria framed by the respondents.

Accordingly, the petition is bereft of merit and is hereby dismissed . However, it has been informed that even General Category students are also admitted and it shall be open for the petitioner to seek admission any other category to which he is eligible.
