Learned counsel for petitioner is directed to comply the order dated 19.01.2024 to implead "State of U.P. through Gram Vikas Adhikari Rataso, Raebareli' during course of the day.

Heard Shri Prasoon Srivastava, learned counsel for petitioner, learned Standing Counsel for the State and perused the material available on record.

By means of the present writ petition, the petitioner, which is Private Insurance Company, has assailed the award dated 09.08.2023 passed by the Permanent Lok Adalat, Raebareli. The Permanent Lok Adalat while allowing the claim filed by respondent no. 1 had relied upon the death certificate issued by the Registrar of Births & Deaths and disbelieved the stand of the petitioner stating that the said death certificate has been subsequently cancelled and the claim was fraudulently made.

To verify the aforesaid facts, this Court had directed the learned Standing Counsel to produce before this Court the proceedings resulting in issuance of the death certificate. The original register maintained by the Panchayati Raj Vibhag, which is known as the Death Register has been produced before this Court wherein at Sl. No. 59, the registration of death of Suman Devi was made on 27.7.2015 stating that she died on 25.7.2015 and the death certificate was received by Sukh Nandan. He has further submitted that till date, the said death certificate has not been cancelled and in case such proceedings has been undertaken then the same could not have been done without due publication. The death certificate has also been uploaded online.

In light of aforesaid facts, it seems that the Insurance Company was not correctly informed about the correct facts by the investigator about the death certificate, which has also been annexed by the petitioner in the writ petition indicating the

same has been cancelled. On the face of it, it seems to be a fabricated and forged document. It is surprising that such a fabricated and forged official document has been relied upon to reject the claim.

Learned counsel for petitioner prays for and is granted a week's time to inform this Court as to under what circumstances and from whom the certificate was received, so that action can be taken against the concerned person/firm.
