Heard learned counsel for the petitioner and learned State counsel for the opposite parties.
Present petition has been filed challenging the order dated 23.11.2022, passed by the District Magistrate concerned imposing penalty upon the petitioner. Also under challenge is the order dated 06.10.2023 passed in Mines Revision No.128 (R)/G & M (U.P.)/ 2022 under Rule 80 of the U.P. Minor Mineral( Concession) Rules, 2021 whereby the revision has been disposed of as infructuous.
It has been submitted that initially vide order dated 23.11.2022, outstanding against petitioner was indicated for an amount of more than Rs.10000000/-. The said order was challenged in the revision but during pendency thereof the order dated 23.11.2022 was amended vide order dated 17.01.2023 whereby outstanding of Rs.1,41,612/-has now been indicated.
In view of the aforesaid the revision was dismissed as infructuous.
In view of the submissions advanced by the learned counsel for the parties, the opposite parties are granted four weeks time to file counter affidavit.
List this case on 22.7.2024. It is directed that in case petitioner deposits an amount of Rs.1,41,612/- along with an amount of 43022/- in the office of District Magistrate Mahoba within a period of 10 days from today, opposite parties may consider the generation of OTP for purposes of continuance of petitioner’s lease agreement. Amount deposited in pursuance of this order shall be subject to final orders passed in this petition.
