Learned Standing Counsel has raised preliminary objection regarding maintainability of the present writ petition as the petitioner has alternative statutory remedy to file an appeal under Section 24(4) of the U.P. Revenue Code, 2006, against the order passed under Section 24 of the U.P. Revenue Code, 2006.
At this stage, learned counsel for the petitioner has submitted that the petitioner may be permitted to withdraw the present writ petition and dismissed as not pressed with liberty to file an appeal.
As prayed by the learned counsel for the petitioner and without entering into merits of the case, the present writ petition is dismissed as not pressed with liberty to avail the remedy as permissible under the law.
