Learned counsel for the petitioner has submitted that the present writ petition has been preferred for issuing direction to the respondent no.1-Additional Commissioner (Administration) Ayodhya Division, Ayodhya to decide the appeal preferred under Section 38(4) of Uttar Pradesh Land Revenue Code, 2006 (hereinafter referred to as "Code, 2006) against the order dated 02.09.2019 passed by the Sub-Divisional Magistrate under Section 38(1) of the Code, 2006 in which the petitioner is also respondent, so a direction may be issued to the respondent no. 1 to decide the appeal within a stipulated time as this Court may fix.

On being asked from the learned counsel for the petitioner whether the petitioner has moved any urgency application for disposal of the appeal before the respondent no. 1, he has submitted that such application has been moved on 23.12.2022 but till date no order has been passed on the same and confined his prayer to direct respondent no. 1 to take decision on the application preferred by the petitioner for early disposal of the case.

Learned State Counsel has not objection to the prayer made by the learned counsel for the petitioner.

On the request of learned counsel for the petitioner and without entering into the merit of the case, the present writ petition is disposed of with a direction to the respondent no. 1 to take a decision on the urgency application dated 23.12.2022 preferred by the petitioner in the appeal pending before the court below, expeditiously, in accordance with law, after giving opportunity of hearing to the parties concerned.

With the aforesaid observations, the writ petition is disposed of.
