Heard learned Counsel for the petitioner and learned Standing Counsel for the State-respondents.

Learned Counsel for the petitioner prays and is permitted implead the Appellate Authority as respondent no.5 during the course of the day.

Let necessary corrections be carried out during the course of the day.

The petitioner has approached this Court with the following main prayers :-

"(i) to issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 16/06/2023 passed by the opposite party no.3 contained as Annexure No.1 and 2 respectively to the Writ Petition.

(ii) to issue a writ, order or direction in the nature of mandamus commanding the opposite parties to not recover the amount from the petitioner in pursuance of the impugned order dated 1/06/2023 and consequential recovery order dated 14/07/2023 passed by the opposite party no.2 and 3 respectively, in the interest of justice."

Learned Counsel for the petitioner submits that the petitioner has already filed an appeal against the impugned order dated 16.06.2023 on the basis of which recovery certificate is issued against the petitioner. He futher submits that the appeal is pending for consideration and prays for decision with expedition.

Considering the said submission, the present petition is disposed of directing the Appellate Authority to consider and decide the appeal, filed on 13.10.2023 (Annexure 9), in accordance with law after hearing all the parties concerned by a reasoned and speaking order within a period of six weeks from the date a certified copy of this order before him. The Appellate Authority shall also take into consideration the judgments relied upon by the petitioner.
