Heard Sri Ajay Kumar Giri, learned counsel for the writ petitioners, Sri Deepak Chauhan, learned Additional Chief Standing Counsel appearing for respondent no. 1 and Sri Shashi Prakash Rai, learned counsel appearing on behalf of respondent nos. 2 and 3.

In view of the order which is being proposed to be passed unnecessarily and is being issued to the fourth respondent. The petitioner claims themselves to be the student of the fourth respondent, K.B.P.G. College Mirzapur, affiliated to Mahatma Gandhi Kashi Vidyapith, Varanasi and according to them, elections are not being held. The writ petitioners claim to have preferred representation before the fourth respondent.

Sri Shashi Prakash Rai, learned counsel appearing for the University submits that there happens to be a writ petition, Writ-C No. 10809 of 2023 (Aman Singh Patel vs. State of U.P. Thru. Principal Secretary/Addl. Chief Secretary Deptt. of Higher Education Lko. & Ors.), pending before the Lucknow Bench of this Court in which certain orders have been passed on 15.12.2013. Though on specific query being made as to whether the said writ petition pertains to the respondent no. 4 institution or not . He submits that in the said case, the college in question is also

affiliated to Mahatma Gandhi Kashi Vidyapith, Varanasi.

Considering the facts of the case and the nature of the relief sought for a direction to decide the representation/claim, the writ petition is being disposed of, granting liberty to the writ petitioners to press their claim, which is pending before the fourth respondent and it is expected the same shall be decided strictly in accordance with law, bearing in mind the import, impact and the effect of the pendency of the writ petitions as noted above.
