Heard Sri Bal Mukund Chaturvedi, learned counsel for the writ petitioner, Sri Deepak Chauhan, learned Additional Chief Standing Counsel appearing for respondent nos. 1 and 2.

The grievance of the writ petitioner is that due to typographical error in the mark-sheet of class 10th, in place of date of birth 10.06.1974, 10.06.1976 was typed. It is also the case of the writ petitioner that in the year 1991 the proceedings were drawn and the papers were also transmitted through proper channel but till date no decision has been taken.

Learned Additional Chief Standing Counsel submits that the issue with the writ petitioner seeking to raise needs determination at the first instance by the Additional Secretary, Madhyamic Shiksha Parishad, Regional Office Varanasi, second respondent. Thus, the writ petitioner may press his claim and approach the authority.

Considering the submission of the rival parties as well as the stand taken by them, the writ petition stands disposed of granting liberty to the writ petitioner to approach second respondent along with a certified copy of the order and with self attested copy of writ petition. Needful be done expeditiously in accordance with Chapter III, Regulation 7 of U.P. Intermediate Education Act, 1921 within a period of two months.
